Stormy Daniels Lawyer Just Told MSNBC That The Payoff In Oct 2016 Was "Absolutely" Intended To Protect Trump Before The Election

This qualifies and breaking news and important news.  Michael Avenatti says that "absolutely, positively" there is evidence that the payoff to Stormy Daniels was timed to prevent the story from coming out prior to the election. Avenatti says that Daniel's previous lawyer, Keith Davidson, will testify that the arrangements were made with Michael Cohen that the payment would be made to make sure nothing was disclosed by Daniels prior to the election.

Stormy Daniels was "blackmailing" Trump by telling him that without a settlement she would go to the media with her story. Cohen paid off Daniels to keep her quiet in the period just prior to the election. 

Avenatti says there is proof of this.

Actually she offered to give all the money back.    But at this point it's clear that neither Trump or any of his bogus aliases were actually a party to the agreement, he merely tried to cover up bank fraud and a campaign finance crime after the fact.

The facts (seemingly) is that they had a sexual relationship.  She was paid off.   She accepted the payoff.   Seems to me the potential for someone to formulate a charge of extortion is high - especially given the powers that she is going against.

Extortion after the fact (after she went public) is hard to see as practical, but extortion at the time might have legs.

Normally that could indicate acceptance of the NDA on her part but the contract isn't a contract unless there are two parties to it, and depending on which of the numerous versions of Trump's and Cohen's stories you want to believe, Trump knew nothing about the contract until after the fact.    What that means is that not only isn't the contract binding on Daniels (because Cohen wasn't acting with the knowledge and consent of his supposed client), but Cohen is both legally exposed and could be expelled from the bar in the states where he practices.

Seems to me the potential for someone to formulate a charge of extortion is high - especially given the powers that she is going against.

Far more likely that Trump tasked his consigliere with covering up any loose ends before the election.   But even if that were not the case Daniels is still insulated from a charge of extortion by virtue of handling this contract through an attorney.   Plus the time for Trump to make an accusation of extortion was when the public learned that hush money had been paid.

But the reality is that the basic facts and some details of the affair have been known since 2011 when "In Touch" magazine published the story.    So any accusation of "extortion" in the context of an NDA signed shortly before the 2016 election isn't credible on its face.

The settlement is what took it out of the realm of extortion and is why it is done that way. Daniels is not a noble character, but neither is Trump (duh!)

If it can be proven that the payment was made to effect the election (or prevent the news of the affair from effecting the election) it is a criminal offense because if it is related to the campaign it has to be reported.

Not sure why this is so difficult for some to recognize as a likely possibility.   Daniels certainly could have threatened to go public - not good for Trump the celebrity or the candidate.   Trump could have easily responded with a payoff.   Neither party is the good guy here.

I would not be surprised if Daniels seeks a book or movie deal at the end of this saga.   Easy scenario, Trump is POTUS so break silence, make a big story, cash in on it.   Wonder how many more Daniels are out there?

That's because the timeline and other details don't fit extortion.

The first reports of an alleged affair between Trump and Daniels were published in October 2011 by the blog  The Dirty  and the magazine  Life & Style .  Around the same time, Daniels talked about the alleged affair with the gossip magazine  In Touch Weekly , which chose not to publish the interview after Cohen threatened to sue the magazine

January 12, 2018: The Wall Street Journal reported that Cohen paid Daniels $130,000 in October 2016, a month before the presidential election, to stop her discussing an affair she allegedly had with Trump in 2006.  Cohen denied the existence of an affair on behalf of his client, Trump, but later acknowledged having paid Daniels $130,000 out of his own money.

In its initial report the Wall Street Journal elaborated that the payment was made through a private company, Essential Consultants LLC. The company was founded by Cohen on 17 October of 2016, in Delaware.  At the time, Daniels was reportedly in talks to tell her account to Good Morning America and Slate.  The Daily Beast was also in talks with Daniels "after three sources—including fellow porn star Alana Evans—told The Daily Beast that Daniels and Trump were involved. Why? The man's personal lawyer made a payment that had nothing to do with the campaign. There's no evidence that the money came from campaign contributions.

Her silence was to deflect criticism from the candidate therefore it is related to the campaign. The difference is whether the payment constitutes a campaign donation and thus failure to report it a campaign finance violation.    That also triggers things like bank fraud laws.

Here's how it works.

Anything that is meant to affect a campaign, even if it is hiring a lawyer to clean up your appearance, by smoothing over and hushing up potential problems, has to be reported as a campaign finance. Since this payment appears not to have been concerned with smoothing over an the issue when it happened years ago, but only recently since Trump's campaign, it makes the payment look like an effort to keep an issue from effecting the campaign, and that's why it needs to be researched further to see if that was indeed the case.

Desperately? No. He is investigating, that's his job. He is following the fact where the evidence leads him. Again, that's his job. 17 total indictments, 5 of trumps own staff and 4 guilty pleas. Looks to me like he is finding plenty. If you truly believe that trump is completely innocent, then you have nothing to worry about. 

One of the things I find curious is that the right wing professes to love law enforcement, and I can honestly say that since I have been using online blogs for the last 10 years, I have seen the right bend over backwards to justify just about everything police do, (even Michael Slager shooting a black man in the back 8 times, caught on camera), but now, the right wing is totally against the largest law enforcement agency in the country, the FBI. I find it quite easy to believe that Trump had a sexual relationship with Daniels and that he had her paid off to keep it quiet.   Waiting for the criminal offenses to emerge before I find this even remotely interesting.

Their issue is a matter of contract law. There exists a non-disclosure agreement whereby Stormy Daniels isn't supposed to talk about her relationship with Trump. If she does, the court is supposed to force her to pay money every time she does. She is currently in breach of that contract and her defense is that the contract was invalid. They are arguing about this in court. It looks like Trump's lawyer paid her a bonus as a kind of insurance policy so she would be less tempted to talk. 

I'm sure I have some details wrong, because I just haven't been that interested. Anyway, none of that is a crime.

I'll wait for the courts decision. There are reasons the contract would be invalid. I don't think that Stormy or her crack lawyer would pursue a suit against the President of the US unless they had a very good case. It would be totally inane, and neither one strikes me as being that stupid.

There does not appear to be any payments made to her until 11 days before the election, so I'm not sure what you're talking about by "extortion at the time of the affair". Trump runs for President and Stormy expresses a desire to talk about her story and the affair she had with the Republican candidate while Trumps wife was at home with a four month old. Cohen then makes an offer to pay for her silence while also threatening her telling her Trumps lawyers would ruin her life if she didn't take the payment and walk away. They obviously didn't want it to get out that Trump was not the man being sold to the evangelicals and supposedly morally superior Republicans and Christian right. So Cohen lied to the bank to get a loan to pay off Stormy committing bank fraud and election fraud and then according to Rudy Trump paid him back.

The affair is something Daniels could have held over celebrity Trump.   She could have tried to cash in on this against Trump the celebrity and got nowhere.  (Trump maybe did not care enough at the time.).  But Trump the candidate had more to lose.

Nobody knows what actually took place between these two, but with the currently available facts it is difficult to not see Daniels taking advantage of her leverage.   Did she try to extort at the time of the affair?   Did she try to extort (and succeed) prior to the election?  Did she get advice from others that violating her contract with Trump was worth the risks because of the potential for real money via book deals and beyond?

Neither party is an admirable character so it is easy to imagine the slimiest scenarios to be likely.

And she "could" have given birth to a secret love child from Trump, but there is ZERO evidence of that or of any "extortion" during the 10 years from the affair to the candidacy. There are only claims and evidence of intimidation coming from team Trump along with hush money just weeks prior to the election in an effort to keep her story out of the news. After the Access Hollywood tape was already out but attention was diverted with the stolen DNC wikileaks release that same day as the tape release (coincidence? I think not), team Trump obviously didn't want another story coming out which would have reignited the sex scandal controversy just prior to the election. To claim it wouldn't have made any difference is beyond ridiculous. That means the $130,000 was specifically paid in an effort to help Donald Trump win the election which is a clear violation of election law and campaign finance laws.

A lot of the evidence has been released, just not ALL the evidence, and the evidence so far points to Trump and his attorneys trying to intimidate and bribe Stormy into silence. She has every right to share her story and likely could have garnered a far larger payment from a magazine or book publisher for her story without having to "extort" anyone. Trumps attorneys were desperate to keep her from talking, bribing her with cash and threatening her with endless lawsuits telling her they would ruin her life if she talked during the campaign.

So you can blame Stormy if you wish, claiming she must be some mastermind of extortion who has held the reigns of the poor helpless billionaire who must not have had any ability to pay for attorneys to defend him or ability to go to the police in the last 10 years and show them how he was the victim of some extortion plan, but you'd have to be awfully gullible to believe that kind of nonsense.

Correct.   They saw a liability.   Are you defending Daniels as a victim?   From what I see, Trump is a scumbag and Daniels is an opportunist.   Put those two together and quite a few possible scenarios emerge.   None of us really know the facts but there is a reason Trumps wanted this hushed (an obvious one) and there is a reason Daniels is out clearly wanting to talk.    Taking Trump or Daniels 'side' seems silly to me (at least at this point).

So you can blame Stormy if you wish, ...

All the Trump supporters seem to think Trump has a halo regardless of the fact he's a serial adulterer, cheated on all three of his wives, has paid huge amounts of money to keep his mistresses quiet, has been credibly accused by at least 19 women of sexual assault, has admitted on an open mic that he "doesn't even wait" for consent and just grabs women "by the pussy". If that is the new definition of a moral leader of the Republican party then fine, just come right out and say it, but to continue to claim the moral high ground while supporting this kind of slime is just beyond hypocritical. That's one of the biggest differences between conservatives and liberals, liberals have often supported legalizing prostitution while conservatives gnash their teeth in righteous indignation against it. So when a Democrat is caught with a prostitute it's not nearly as hypocritical as it is when a republican who has built their career on vilifying Democrats for their support of such is caught doing the exact thing they had been accusing their opponents of and telling the voters they shouldn't vote for the Democrat because of their lack of moral fiber.

So it's not so much "Trump bad", that's a given, how else could you view a serial adulterer, serially bankrupt narcissist who lies more than he tells the truth. The real issue is "Republicans Hypocrites" for supporting such a candidate that they all knew had no morals, has no values and is only telling his supporters what they want to hear. Even when Trump lies he can't get it right, like when he talked about knowing that scripture in "two Corinthians", how obvious a give away was that? No Christian from the time they were 6 years old would have referred to it as "two Corinthians" but the evangelicals and Christian right gave him a pass anyway because he was telling them what they wanted to hear. No, it really doesn't look like any of those things. Just saying that it looks like those crimes, absent any explanation, is not convincing. There is no reason to think that this expenditure or any other on behalf of Trump - the man - is a campaign finance violation. Even politicians running for office have personal expenses. The money comes from their own bank accounts and Trump's accounts have plenty to spare. I have seen nothing specifically connecting this payment to money he raised via campaign donations. Heck, most of his campaign was self-funded. He's the candidate least likely to dip into campaign funds for money.

And even if the money did somehow come from campaign accounts, the resolution is repayment of the money and a fine. I think Bernie Sanders had to do something like that himself. It's just not that big of a deal. Bank fraud is similarly a groundless accusation and tax fraud I leave to the IRS.

As always it's the coverup which is the real crime.

Covering up an affair isn't a crime . . . unless you do it under oath. (See: Clinton & Lewinsky)

As Trump's lawyer what he says in public represents Trump's position. That is election fraud. Also if he paid Cohen the $34,000 a month to repay him for Stormy Daniels, knowing that it was invoiced money for legal work that was not preformed, plus a little profit for the firm and some for the IRS (as Rudy said) then that is also fraud and also an IRS felony. Also Rudy said that Trump paid a total of $470,000 in this manner, that begs the question, what was the extra money for? Did he pay someone else off that we don't know about? Did he pay extra "shut up" money to Cohen? And mostly, Rudy and Trump say they got together and put together this legal strategy (in private) themselves and sprang it on everyone else with no notice on TV. If that is true (and every source says it is) then other then legal suicide, what in the fuck were they hoping to accomplish?

Because this sure seems to be something that was planned out by two senile old men whose IQ (combined) is still in about the 70 degree range. The only conclusion one can reach is that Trump and Rudy are batshit crazy. Even Neil Cavuto is on FOX News wondering why Trump is lying so much and why the stink of the swamp he said he was going to drain is coming from him and if Trump loses Cavuto...he loses period. Probably true but note that the Daniels case is really about the cover up of a campaign finance violation, and that will move through the courts much faster than the Mueller investigation.

Very true ... it is all speculation (doubt anyone is telling the truth), yet "blackmail" is used in reference to Daniels actions -  'blackmail' is not that far of a stretch, I doubt Cohen went looking for her to offer her money as a 'precaution', but I suppose it could have happened that way.  Daniels took the money, signed the contract, then broke the agreement and her silence to tell a story of a 'one night stand' with the man that 'would 10 years later be' President....    her story is ever bit as skewed as the presidents denial.

I am still trying to figure out when a 'one night stand' became an affair................

Her telling is it seems a one off event it was the other lady in the news that had the ongoing affair and it appears she full anticipated it would last much longer. Her agreement while paid was still not finalized and not enforceable. she would however by ethics need to return the money if she decided to forego the contract. Given the unethical parties to the contract she could actually keep the money and do what she damned well pleased, lie down with dogs get up with fleas.

Makes no difference to me .. slow news day - I read "absolutely, positively" there is evidence" ... so figured I would not have to think too hard to comment on this subject matter ... I just see it as a two lane dead end street - I find it hard to believe that this will bring Trump down (do not think felony campaign finance laws can be proved to have been broken) .. unless, did Daniels work on the Trump campaign and have connections with the Kremlin?

If it does bring Trump down, so be it - I planned to write in Nikki Haley in 2020 anyways!

1) Trump denies the affair even happened. "Fake News". 

2) Trump says he didn't know about the 130k paid to Daniels in the affair that never happened.

3) Rudy G. says Trump DID pay the 130k to Cohen...in the affair that never happened.

And the cons bought it every time trump said it....

Which is a misdemeanor election campaign financing violation. IF it can be proven that Trump knew about the payoff at the time, it could be a felony campaign financing violation. John Edwards was crucified when it was found out donors paid Rielle Hunter during the 2008 campaign.

Stormy Daniels was "blackmailing" Trump
