A September CBP update on progress with President Donald Trump's proposed border wall found several prototypes were "breached" during recent tests and tunneling was not addressed in its border security analysis.

Mexican and U.S. law enforcement agencies discovered a highly sophisticated underground tunnel—featuring a rail system and solar-powered lighting—running underneath the border between Mexico and California. 

The San Diego sector of U.S. Customs and Border Protection are investigating an unfinished tunnel they believe drug smugglers and human traffickers were building that was found starting at a residence in Jacume, in the Mexican state of Baja California. On September 19, Mexico State Police, Policia Estatal Preventiva (PEP), and Mexican military forces found the tunnel opening approximately 221 feet south of the border. The tunnel continued north, running underneath the border between the two countries, according to a U.S. Customs and Border Protection (CPB)  report   released Tuesday. 

Those building the tunnel had not yet created an exit point at a U.S. location yet, but the underground passage did feature two sump pumps, a solar-powered lighting system and comfortable ventilation. Additionally, a rail system ran the entire length of the tunnel into the United States.

  • illegal immigrants do not have a constitutional right to cross our borders
  • we have the constitutional right to bear arms
  • we also have a constitutional right to secure our borders from illegals

so NO, not the same kettle of fish, but hey nice try.

But as soon as they cross the border they have the exact same Constitutional rights that any citizen has.  That FACT is in the Constitution.

Over two hundred years of Supreme Court law have established that persons who enter the country unlawfully and bear no connections to the U.S. do not have the full scope of affirmative constitutional rights of a U.S. citizen.

The U.S. Constitution recognizes the humanity of all people who are present within its borders, regardless of whether they enter legally or illegally, are temporary or permanent.  Undocumented immigrants are constitutional “persons,” but they do not have all the rights of a U.S. citizen.  The Constitution protects all immigrants (legal and illegal) against “wanton or malicious infliction of pain” by government officials and from “gross physical abuse.”  See, e.g., Castro v. Cabrera, 742 F. 3d 595 (5th Cir. 2014).  The Supreme Court also recognizes that mere presence gives all immigrants a limited set of due process rights relating to their process of immigration, deportation or detention.  See, e.g., Demore v. Kim, 538 U.S. 510 (2003).

The protections that illegal immigrants have against harm are negative liberty rights, i.e., to prevent.  The right to an elective abortion is an affirmative liberty right.  Centuries of Supreme Court precedent establish that illegal immigrants who have not developed connections with the country do not have the full scope of affirmative liberty rights that are reserved for citizens. The vesting of the full scope of constitutional rights occurs upon naturalization, when a person becomes a citizen – it does not occur when one presents oneself unlawfully at the border.

This is why you need the wall. The wall forces determined criminals to dig tunnels, which our agents often find before the tunnel is even completed. It takes moments to walk across an open border, but it takes months to dig the tunnel. Slowing these people down makes it much easier to stop them and even catch them. Additionally, it discourages others from even making the attempt. Modern sensors in the new walls make it even easier to detect such digging.

Not a choice we have to make. Try reducing other government spending instead. Democrats never talk about just spending less. And it's not as if this or that thing is not a nice goal or a good idea. It's just that some things could be handled by the private sector and might even create some jobs along the way.

0 the government already collects over 3.5 trillion a year they just need to use the money wisely stop feeding fat people and paying people not to work would be a good place to start.

Well the wall is over 73 billion.  The tech is the expensive part.  Installation, configuration, testing, maintenance, replacements, and upgrades.

So yes, I think a trillion dollars for a 2000 mile stretch, that keeps things tight enough to not allow anyone through without detection.

I'm all for leaving the tunnel.  Just line it with M18A1 Claymore Mines and flash bangs (on the US side).  Mix up the combination all set to go off by tripwire.  After a few months just fill it with concrete.
