A President Falsely Charging ‘Treason’ Is What the Founders Feared
Trump’s accusations violate his oath of office.

Donald Trump swore to protect and defend the U.S. Constitution.

The Constitution declares, “Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort.”

On Wednesday, President Trump   wrote , “I think what the Democrats are doing with the Border is TREASONOUS. Their Open Border mindset is putting our Country at risk. Will not let this happen!” As having an “open border mindset” is not levying war against America nor giving aid and comfort to its enemies, Trump is guilty of levying a false accusation of unsurpassed gravity and additionally guilty of   violating his oath   to protect and defend Article III, which defines treason as “only” those offenses.

That same day, the oath-breaker   wrote , “So, it has now been determined, by 18 people that truly hate President Trump, that there was No Collusion with Russia. In fact, it was an illegal investigation that should never have been allowed to start. I fought back hard against this Phony & Treasonous Hoax!”

The people who started Robert Mueller’s investigation did not levy war against the United States, adhere to its enemies, or give them aid and comfort. As such, Trump is guilty of levying another false accusation and additionally guilty of   violating his oath   to protect and defend Article III.






Days before, Trump   wrote , “Why should I be defending a fraudulent Russian Witch Hunt. It’s about time the perpetrators of this fraud on me and the American People start defending their dishonest and treasonous acts. How and why did this terrible event begin? Never Forget!” Trump, it turns out, violates his oath of office   a lot .

On February 18, he   wrote , “‘The biggest abuse of power and corruption scandal in our history, and it’s much worse than we thought. Andrew McCabe (FBI) admitted to plotting a coup (government overthrow) when he was serving in the FBI, before he was fired for lying & leaking.’ @seanhannity @FoxNews Treason!” Trump appears to regard himself, rather than the people, as the nation’s sovereign, like the tyrant king whom the Founders rebelled against.

In 18th-century England, royal accusations of treason were “a means of suppressing political dissent and punishing political opponents for crimes as trivial as contemplating a king’s future death (what was known as ‘compassing’), or speaking ill of the king (‘lèse majesté’),” the University of Texas law professor Steve Vladeck   wrote . “King Henry VIII even had two of his six wives executed for alleged adultery on the ground that such infidelity was, of itself, ‘treason.’”

Vladeck continues:


The English abuse of treason was anathema to a nascent republic dedicated to the rule of law and the right of peaceful dissent. Thus, to ensure that treason could not likewise be co-opted for political or personal purposes, the Constitution’s drafters not only defined it precisely (it’s the only offense specifically defined in that document), but also specified, “No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act ...”

The Framers were guarding against the possibility that Americans would one day elect a man so morally weak and corrupt that he would falsely accuse political enemies of treason. In 2016, Americans narrowly elected a man who is that degraded. Congress and the judiciary have a constitutional duty to check his abuses of power, and the public has a patriotic duty to oust him from office. But as yet, most Republicans show no inclination to mount a 2020 primary challenge, as if they are content to continue supporting a man of low character.

Their failure, while disconcerting, is not treason, as it is neither levying war against the United States nor adhering to its enemies nor giving them aid and comfort.

trump’s accusations are accurate.

what the founders feared was using fabricated evidence and abuse of power to bring down a sitting president.

the coup failed...  the plotters are scared.

we will not be living in a country where every time the left losses they try to overthrow our govt.

people must, and will be made examples of.

besides, the founders loved the idea of traitors receiving justice also

Since the President is not an attorney, we could hardly expect him to use the proper legal terminology.  Treason is a term that everyone understands, so that is what he used.  The correct term is sedition, which does not have the very tight list of elements that treason has.  It is much broader than treason.

From the Merriam-Webster Dictionary:

Definition of sedition

: incitement of resistance to or insurrection against lawful authority
That definition certainly includes using fabricated charges to undermine the lawful authority of the President.
I might add that just being a member of a seditious conspiracy, even by just supplying them with information, will get you ten years in a Federal prison.

he has plenty of attorneys and military intelligence has had trumps six since day 1.

some people in the media who worked with the fbi to spread known lies in the press/ aka "resisted" might be surprised with this one.

Treason:
the crime of betraying one's country, especially by attempting to kill the sovereign or overthrow the government.   fabricating evidence to take down a sitting president / overthrow an election, is included here.
hint: actions overthrow

abuse of power:

that charge will be thrown around like cheap candy. abuse of power for everyone.

The idea that the FBI and the DOJ conspired to overthrow Trump is a right wing conspiracy theory without any proof. 

The right wants the very fact that Trump was investigated to symbolize a "plot" against him. The intelligence services were given troubling indications that his campaign might be in collusion with Russians, and they investigated it. They did their job. The few responsible Republicans that are left in Washington have acknowledged that. 

IF the FBI or CIA or DOJ had unlawfully or conspiratorially investigated Trump you would have heard about it from official sources by now. 

Ask the FBI director appointed by Trump, Christopher Ray, what he thinks of this conspiracy crap and then get back to us.

lisa page testified under oath obama knew what was going on. everyone involved knew the info was fabricated, the author "steele" testified under oath he made it all up based on a post on cnn's Ireport pages.

it has been in the news, you have just been calling people stupid every time they brought it up

You're kidding right? 

Barr has been widely criticized for using that term. Besides that he said one second later that for all he knew it was justified by the facts.  That is what he meant by the term "predicated".

You basically repeat things you see on Fox News or other right wing media. 

This reminds me so much of what was supposed to come out of "Benghazi" (Clinton, Obama, Susan Rice, Valerie Jarrett, etc. would all wind up in jail) 

I hope we don't have to go through 9 investigations of James Comey and Lisa Page to get to the point of realizing there is no there there.

No John, Benghazi was about a spectacular, avoidable failure by the Clinton State Department and the ham handed lies by the administration in the aftermath. All of that was proven, in spades. Remember the non existent "protests" ignorant liberals clung to for months?

The analogy you are reaching for  is to liberals claiming Trump colluded with Russia and is a traitor. you know, the made up b.s. the completely made up allegations they've  been spewing since they lost the 2016 election.  that's the perfect example of a spurious, illegitimate  conspiracy theory consuming a political party.
