The left is becoming totally unhinged by the circumstances they are presented with.  We are ready for them.  We say bring it on.  Make the threats.  Let every one know the degree you are willing to sink to try to use force threat and intimidation to get your way.  The author is right.  There is plenty of precedent for election year nomination and confirmation of Supreme Court justices when the President and Senate majority are with the same party.

Americans were given little time to remember the legacy of Justice Ruth Bader Ginsburg , an indisputable trailblazer for women and titan of the law.

Her passing, after fighting four kinds of cancer for years, should serve as inspiration for all of us.

However, immediately woke activists reminded us that Kavanaugh-like attacks are guaranteed to whomever the president nominates to replace her.

The historic effort Concerned Women for America (CWA), the organization where I serve as CEO, had to deploy to combat the unjust attacks against Justice Brett Kavanaugh prepared the way for what will be needed to withstand the unhinged attacks coming from the radical left.

MALCOLM AND SLATTERY: RUTH BADER GINSBURG WAS A LIONESS OF THE LAW

We were maligned, threatened with violence, and harassed for our views.

It was miserable and frightening but now we are battle-tested.

I confess, I felt sheer dread reading some of the left’s reaction to the news of Justice Ginsburg's death on Friday night, even as we prayed for the Justice's family during this difficult time.


“We’re shutting this country down if Trump and McConnell try to ram through an appointment before the election,” tweeted Beau Willimon, President of the Writers Guild of America.

“If he tries to appoint someone, it’s civil war, and I’ll be on the front line,” replied Linda Brown, who described herself as a grandmother and part of “Team Resistance.”

The "Young Turks" host Cenk Uygur, who always seems willing to share something verbally toxic said , “There is no way in the world we're going to let the Republicans fill Ruth Bader Ginsburg's seat… Under no circumstances!!”

“Over our dead bodies. Literally,” chimed  author Reza Aslan.

And those were the tamer responses!

At first glance, they are making the demand that Senate Majority Leader Mitch McConnell apply the rule the Senate used to put a hold on President Obama’s Supreme Court nominee. Only they know that rule does not apply in this case.


Senators, like parents, must ignore the tantrums. The Constitution sets a process. They have a charge. They must execute.

That procedural rule stipulates that, when an opposing party to the president holds the Senate, no Supreme Court confirmation should be confirmed during a presidential election year.

The reasoning behind it is that the people have spoken both in selecting the president and in giving the Senate to the opposing party, so they should consider that and decide which way to go with the nomination in the election.

That is not the case now. America elected Donald J. Trump as president (largely on his pledge about the selection of Supreme Court justices) and also voters expressed their complete confidence in that vision by giving the majority to the Republican party in the Senate.

The left knows this, despite the drum they will be banging for the next few months.

So, what is fueling the over the top, visceral reactions?

The left has gone completely unhinged. We could fill volumes with the more extreme reactions.

The answer, as is usually the case these days, is a five-letter word: Trump.

As the CEO and President of CWA, I experienced this irrational hatred of Trump directed at Justice Brett Kavanaugh in our “ Women for Kavanaugh ” effort during the last confirmation battle.

I vividly remember the “Women’s March” sending out their press release forcefully opposing “XX.”

The left hated Kavanaugh before he was even nominated.

A rally at the Supreme Court featured pre-made signs for any nominee they thought possible. The official Twitter account of the Democratic Party tweeted and then deleted an image of the wrong judge, saying, “Let’s be clear: A vote for #KavanaughSCOTUS would be a vote to rip health care from American families …”

You see, it didn’t matter who the nominee was nor his or her record. What mattered was that it was President Trump’s nominee.

The same is true today.

That is why some on the left are hysterically threatening violence. Like an uncontrollable teenager, all the radical woke left does is based on raw emotions. They have symbolically placed all their pains and frustrations on President Trump.

We don’t discount their emotions; we acknowledge them.

It was one of the saddest things I experienced at the Kavanaugh hearings, once the unfounded sexual allegations were revealed.

Here were women who had been hurt deeply by this issue in one way or another, who were opposing Justice Kavanaugh based on their personal experiences. He was the sacrificial lamb to atone for their offender.

It did not matter that the evidence before us was not credible. They just felt deeply. They were ready for war because that was their reality.

This was all stoked by big spenders on the left who only wanted to use these women for their own political purposes.

The fact that they harmed an innocent man, his family, and other women was an inconvenient truth.

In one revealing moment, CWA Women for Kavanaugh supporters stood alongside leftist protesters inside Republican Sen. Susan Collins’ office.

It was tense. Women were taking turns telling their #metoo stories. They demanded all victims be heard. But when Annabelle Rutledge, a CWA staffer, told her story, all of a sudden, they shouted at her angrily, shutting her down and calling her a liar.

Expect more of this.

Truth and facts and the nominee and his or her record have little to do with what is to come.

The left just feels. And they will let you know it.

I’m just glad that the leader of Concerned Women for America is an opinion writer for Fox News so that we can see the views of America’s largest women’s group on the issue instead of the usual bs from NOW.  All the ammo that the left used against Kavanaugh will be useless against any of the three highly educated career women lawyers, professors, judges that Trump might pick.  I like all three for different reasons.  Cushing being only 38 is awesome.  I’ll be happy with any one of them.

I expect that the Left will attack the nominee on the issues. They may not be fair about it, but that's where they'll go. If the parties were reversed, the Right would do the same thing. But here's the difference:

If the nominee were on the Left, Democratic politicians would play the sex card in her defense. Every criticism or concern would be dismissed as sexism or misogyny. From what I have seen, Republicans are unlikely to do that. That means she will be demonized and no one will shame the people doing it.

An Argument for Filling Ginsburg’s Seat Immediately

In the aftermath of the death of Supreme Court Justice Ruth Bader Ginsburg, tensions on both sides of the aisle are high. With a hotly contested General Election just weeks away, some in the pundit/activist spheres, conditioned by the acceptance of civil unrest in our urban areas, are calling for acts of violence should President Trump nominate his pick to fill the vacancy on the bench. The problem with this, besides the obvious, is that Mr. Trump has no choice but to deliver his nomination to the Senate for confirmation unless he is to be irresponsible to the nation’s needs and the Constitution’s mandates.

In an array of tweets, several self-important personalities issued violent threats against the country should the President and the Senate actually do their constitutional duties:

    • “If they even TRY to replace RBG we burn the entire f—–g thing down” and “Over our dead bodies. Literally,” tweeted Reza Aslan, an Iranian-born CNN host, born-again Islamist, and author.
    • “F–k no. Burn it all down,” tweeted Aaron Gouveia, author of Raising Boys To Be Good Men: A Parent’s Guide to Bringing Up Happy Sons in a World Filled with Toxic Masculinityand Father who defended his 5-year old son’s right to wear fingernail polish.
    • “We’re shutting this country down if Trump and McConnell try to ram through an appointment before the election,” tweeted Beau Willimon, a former aid to John Dean’s failed Senate bid and screenwriter who pilfered the idea for House of Cardsfrom the British version.

  • “Burn Congress down before letting Trump try to appoint anyone to SCOTUS,” tweeted Emmett Macfarlane, a Canadian professor at the University of Waterloo in Ontario, Canada.

If you are disturbed by the level of hatred, aggression, and complete disregard to the rule of law and the US Constitution then you haven’t been paying attention to what has been going on in the whole of America’s urban centers for the past six months.

But what both the foreign nationals and the US citizens noted above do not understand, for their constitutional illiteracy, is that there are two pressing reasons why Justice Ginsburg’s seat needs to be filled before the November election.

First and foremost, the country needs a full compliment on the US Supreme Court should there be any contest to the election results this November the likes of Bush v. Gore in 2000. A deadlocked 4-to-4 decision regarding the election of a president would send a fireball of violence into the streets of our nation, not to mention dismantle continuity of government. With our nation as divided as it is, we would almost assuredly devolve into a Second US Civil War.

But more important is that the President and the US Senate are mandated by the US Constitution to execute the workings of government. The moment a vacancy is created it is mandated that the process of filling that vacancy begin. The bad precedent that politicians have set in elongating this process is just that: bad precedent.

Article II, Section 2 of the US Constitution states, in part:

“[The President] shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law…”

As you can see, nowhere in this Article, or anywhere else in the US Constitution, does it call for a period of mourning, an exception in an election year, or a hiatus due to an impending election. The US Constitution simple vests the authority and mandates its execution.

Just as when the vice president is immediately sworn in as president when a president is tragically taken from us, so too is it necessary to immediately begin the process of filling vacancies in every other constitutional branch of office and especially in the face of a critical national election. The execution of these constitutional duties is not a sign of disrespect for the recently passed, it’s a mandated exercise in continuity of government, and that is government’s obligation to its people.

Politicians would love to drag out the filling of Justice Ginsburg’s seat on the bench for political reasons; to suit their political agendas. Activists, Marxists revolutionaries, and ideologues would relish the elongation of the process in hopes that Mr. Trump loses his re-election bid so that Biden (or Harris) might nominate someone approved by the group-think, oligarchic elite of the Marxist-Progressive Left, the cabal that controls all things Democrat.

But politics is not government. Let me say that again. Politics is not government. We all have gotten so used to mistaking political acts for acts of government that we have become accepting of the falsehood that the political parties have any legitimacy in the execution of government. We have been duped into believing that politics is government, but politics is not — and never should have been — a component of government.

The shrieks of the political class who threaten retribution are the sounds of ideologues threatening the US Constitution. Politics and political operatives hold no sway over the mandates of the US Constitution. And while the Sen. Schumers and Speaker Pelosis of the Left talk about a period of mourning, that mourning must happen simultaneously with the execution of government, which means the seating of a ninth US Supreme Court justice prior to a national election.

President Washington warned us in his farewell address that politics would be the ruin of the Republic. So far, his warning has been both spot on andignored. Where some would say the enemy is inside the gates, I put it to you that the enemy is, in fact, elected to office....

If Scalia had not died until after the election and was replaced by trump then, we all know joe Biden would be resurrecting the Biden rule right now.   Garland gives them a talking point,  but they’d be just as outraged and determined to stop anyone from taking Ginsburgs seat regardless.  

We have  almost 40 years of history to go by. Democrats never let the republicans confirm a nominee without total war.

That might have made a difference but the full issue is that in an election year when the President and Senate are held by different parties the nomination rarely if ever goes through but if the senate and White House are controlled by the same party they almost always are confirmed.  About 1/4 of all Supreme Court appointments have been approved during an election year.

Sure. I think that - as a practical matter - McConnell saved everybody a lot of time, effort, and money. I think it would have gone over better if he had explained it that way. Both houses of Congress forego taking certain actions or passing certain bills all the time if they know they don't have the votes.
