The acting secretary of Homeland Security is taking aim Tuesday at new laws in New York, New Jersey and other states that allow immigrants to get driver's licenses without proof they are in the U.S. legally, and restrict data sharing with federal authorities.



Chad Wolf sent a memo to all the components of Homeland Security, which include U.S. Customs and Border Protection, the Coast Guard and the Transportation Security Administration, requesting a department study on how the laws affect its enforcement efforts for both immigration and other investigations into human trafficking, drug smuggling and counterterrorism.



New York's law went into effect earlier this month, and migrants lined up to get documents. It was the 13th state to authorize licenses for drivers without legal immigration status, and most of the other states also restrict data sharing. New Jersey lawmakers passed  a similar bill  in December.

New York Gov. Andrew Cuomo and New York City Mayor Bill de Blasio, both Democrats, are frequent thorns in the side of the Trump administration's efforts to restrict immigration. New York City is home to an estimated 500,000 immigrants in the country illegally.

The laws prohibit state Department of Motor Vehicles officials from providing data to agencies that enforce immigration law unless a judge orders it. New York cut off database access to at least three federal agencies last week when the law went into effect.

Wolf said in his memo, obtained by The Associated Press, that the department must be "prepared to deal with and counter these impacts as we protect the homeland."

An estimated 265,000 immigrants without legal documents were expected to get driver's licenses within three years, more than half of them in New York City, according to the Fiscal Policy Institute.

Applicants must still get a permit and pass a road test to qualify for a "standard driver's license," which cannot be used for federal purposes like an enhanced driver's license or Real ID.

Wolf's directive asks that each agency survey what DMV information is already available, how it is used in day-to-day operations, and what the security consequences are without the data.

New York authorities and other state officials say the laws are meant to lower the number of uninsured people, improve traffic safety and allow for better opportunity for work.

In scripture, divorce is supposed to be against God's law, but it's allowed under Mosaic law because the alternatives were so much worse. Men who didn't want their wives were abandoning or killing their wives to avoid divorce. It's kinder and smarter to just allow divorce.

Similarly, licensing illegal aliens is one of those things where you want things to be a certain way (i.e. everyone is in the country legally), but if it isn't going to be that way, you have to make the best of it. That's sort of how I see this issue.

The people are here and they're going to drive. Unlicensed drivers are more likely to be in an accident and they're more likely to flee the scene of an accident. Even where they stick around, they're also more likely to be uninsured. 

If you can't make all those people disappear from the roads, you need to deal with the problems they present. Sharing their information with federal immigration authorities is just going to discourage them from going through the licensing process.

I'm sympathetic, of course, to the homeland security concerns, but as we often say about gun control, criminals don't care about your laws.

Even where they stick around, they're also more likely to be uninsured.  If you can't make all those people disappear from the roads, you need to deal with the problems they present. Sharing their information with federal immigration authorities is just going to discourage them from going through the licensing process.

Here is the other side of that idea (courtesy of Thomas Homan) :

"New York will give you a heads up to run and hide if immigration authorities request your information. That clearly seems to impede federal law enforcement officers from doing their job and actively conceals individuals from arrest.

There are other issues to consider as well. One is the documentation these immigrants will bring into the DMV in order to identify themselves. DMV employees are not experts at identifying true foreign documents and the “matricula” card issued to citizens of Mexico has been identified as extremely vulnerable to fraud by the FBI.

In addition, the issuance of more drivers’ licenses based on potentially fraudulent documentation is likely to lead to more voter fraud. Maybe that’s why the left is pushing this agenda so hard. Between this and returning voting rights to convicted felons, it looks like lawmakers are trying to stack the deck against Republicans.

Another question to consider is how these new laws square with the Real ID Act. Secure drivers’ licenses and identification documents are a vital component of our national security framework. The Real ID Act, passed by Congress in 2005 on the recommendation of the 9/11 Commission, established minimum security standards for certain documents and prohibits federal agencies from accepting IDs that don’t measure up.

The left also argues that these laws will lead to safer highways and fewer traffic fatalities. But multiple studies from across the country over the last decade suggest otherwise. California has reported an increase in hit-runs and Illinois more traffic fatalities since their respective state lawmakers granted licenses to illegal immigrants.

Politicians who support and enact these ridiculous statutes have no respect for the rule of law and are putting their constituents in danger. They seem to believe that those who violate the laws are victims who deserve rewards and those who enforce the law are the bad guys whose agencies should be abolished.

They are also exacerbating the illegal immigration problem. How many more people will be encouraged to enter this country illegally because of the rewards and enticements that await? And in the process, cartels will get richer, and more children will die and more women will be sexually assaulted while attempting the journey."

I'm not sure why that would be. Like the driver licenses, voter registration is usually based on proof of residency. Most people will probably produce some kind of utility bill or pay stub or something else that shows you live where you say you do. Who you were back in the old country isn't very relevant.

Another question to consider is how these new laws square with the Real ID Act.

Current law is that licenses have to explicitly say if they don't comply with federal standards, so you aren't going to get on an airplane with your illegal alien driver license.

California has reported an increase in hit-runs

This one is harder to establish a causal connection with because most perpetrators of hit and run get away, making it kind of impossible to identify them. California's hit and run rates are currently almost equal to what they were in 2006 after dipping to lows around 2009 and gradually coming back up. The driver license law didn't take effect until 2015.

Great alternative to a nationalistic, "my country can do no wrong attitude". It should always be taught with traditional history books and anything outlining the rise & fall of Germany's third Reich.  One can never be too well rounded in human history.
