Let's be lucid. 

Republicans control the Supreme Court nominating process. If they wish to put another conservative on the Court, they can.

So they will.

Democrats must announce, now... loud an clear... that the consequence will be changes in the nominating process. They must announce that they will increase the number of Justices to thirteen, with four new justices.

FDR attempted to pack the Court. Such a tactic didn't find support then, and it won't now.
