But Republican Sens. John Cornyn of Texas and Thom Tillis of North Carolina are calling the Democrats' bluff when it comes to Deferred Action for Childhood Arrivals beneficiaries.

Created by President Barack Obama, without any congressional authorization, at the height of the 2012 election, DACA made protected legal status and work permits available to possibly millions of illegal immigrants who could prove they entered the United States before their 16th birthday, lived in the U.S. for at least five years, and were under the age of 31 as of 2012. These "Dreamers" deserved protection, it was argued, because they were brought to this country as children and therefore should not be held accountable for illegally entering our country. Over 600,000 illegal immigrants came forward to claim DACA benefits.

At first, the DACA program did not face any organized legal challenges in court. But after Obama expanded the program in 2014 to include illegal immigrants who did enter our country as adults and also had legal children in the U.S., a group of 26 states led by Texas sued to stop that new program from being implemented.

Arguing that Obama exceeded the authority granted to him by Congress, Texas defeated the Obama administration in federal district court, a ruling the Supreme Court eventually upheld.

Now, Texas and eight other states are back in court, challenging the original DACA program, and it is looking like Texas will win again. While it is unclear what remedy the judge will grant Texas, it is possible DACA recipients will lose their work permits.

Democrats want to use the possible loss of DACA to pass a much wider amnesty for all illegal immigrants who enter the country illegally as minors. This would include those who entered the country five years ago, those pouring across our border today, and those who cross illegally in the future.

Facing a probable court decision that will take legal protections away from current DACA beneficiaries, Cornyn and Thillis have asked Senate Judiciary Chairman Dick Durbin, an Illinois Democrat, to schedule a hearing on narrow legislation that would grant permanent legal protections only to current DACA recipients.

This was not enough for Durbin, who told reporters he was "disappointed" in the Republican offer and declined to schedule such a hearing:

Now that the Democrats have rejected Republicans' honest effort to protect current DACA recipients, it is clear that it is the Democrats' desire to use DACA recipients as cover to achieve maximum amnesty that is to blame for any loss of protection for DACA recipients.

Yeah, I suppose compared to progressive liberals' plans,  one which would grant permanent legal protections only to current DACA recipients sounds downright fucking draconian.
