President Biden has nominated a record number of diverse judges to the federal judiciary, with nearly 65% being people of color, according to an analysis by Balls & Strikes.

The outlet found that out of 97 confirmed federal judges, five are White men and 22 are Black women. Female judges make up 66% of the confirmations compared to 24% under former President Donald Trump and 42% under former President Obama.

Project 21 co-chairman Horace Cooper called out the Biden administration for its seemingly race-based confirmations Monday, arguing it is trying to replace excellence and merit with diversity.

"What we're seeing from the Biden administration, and which is what we're seeing generally from the progressive movement, is this idea that we just need to reshape the judiciary in a way under color," he said on "Tucker Carlson Tonight."

"I use that term in a duplicative way by pretending that we're making the courts look more like America. But the truth of the matter is we're finding people - they aren't talented, they aren't highly-skilled, but they know progressive vision just like the back of their hand."

Cooper added that America ultimately "suffers" because of this practice.

Host Tucker Carlson highlighted an exchange between Sen. John Kennedy, R-La., and Biden judicial nominee Charnelle Bjelkengren.

Bjelkengren could not answer Kennedy's questions about what different parts of the U.S. Constitution do, saying certain articles were not "coming to mind."

Carlson said the response was "unbelievably degrading" and wondered why Biden nominated a judge who "knew nothing" about the Constitution.

Cooper agreed, adding he does not want people to be hired to prestigious positions only on the basis of race.

"I don't want the cardiologist to be chosen by his color. I don't want the pilot to be chosen by his race. And I don't want the judiciary to be chosen that way," he explained. "We need excellence. And this administration doesn't want that criticism."

Beyond her legal knowledge, at issue is Bjelkengren's experience.

On her Senate Judiciary questionnaire for her nomination, Bjelkengren was asked to provide details about the "10 most significant litigated matters which you handled." Bjelkengren listed only six , including one case in which she lost to someone on appeal who forewent legal counsel and was representing herself. 

"At no stage of her professional career has this judge focused on federal law. At no point has she ever even appeared in federal court," Senate Minority Leader Mitch McConnell, R-Ky., said on the Senate floor last week. "Is this the caliber of legal expert with which President Biden is filling the federal bench? For lifetime appointments? Is the bar for merit and excellence really set this low?"

Bjelkengren worked for several years as an assistant attorney general in Washington state. She primarily served as an administrative law judge, representing the Department of Licensing in drivers' license revocation hearings and the Employment Security Department in unemployment benefits cases.

Never even appeared in federal court?  How the fuck can she be considered for a lifetime appointment to the federal bench when she has zero experience at the federal court level?  This really takes diversity far beyond any logical point.

Seemed to be a common complaint during the last Administration with mostly partisan objections to the lack of both diversity and real legal experience, now resulting in real crackpot decisions by certain Appeals Judges.

Several of the previous Administration's judicial nominees had never tried a case, taken a deposition, examined a witness, or argued a motion in court.  In other words, they had absolutely no experience that would qualify them for any judgeship much less a lifetime appointment to the federal bench.  What they did have was an extremist right wing political philosophy and the backing of the ultra-reactionary Federalist Society.  I don't recall seeing NT's so-called "conservatives" registering an objection to any of those completely unqualified nominees.

No hitler openly admired the jim crow segregation laws of the southern democrats. The new style DEI programs the democrats now champion are far more subtle but very effective.
