D r. Anthony Fauci took major heat after lamenting on Thursday that it was "disturbing" that a federal court would rule against the CDC’s COVID-19 travel mask mandate, adding his opinion that "This is not a judicial matter."

Prominent conservative Twitter users crushed Fauci for his "stupidity", with many accusing the National Institute of Allergy and Infectious Diseases director of thinking he and the CDC "are above the law," and of being "hell bent on using Covid to control people."

Fauci’s irksome comments happened during a Thursday interview with CBS News about U.S. District Court Judge   Kathryn Kimball Mizelle   striking down the travel mask mandate on Monday. 

During the segment on the streaming show "Red & Blue," CBS anchor Robert Costa asked Fauci, "Do you personally agree or disagree with her interpretation of public health law?"

Fauci responded, "Well, I clearly disagree, I mean those types of things should be decided as a public health issue by the public health organizations, in this case the CDC. This is a public health matter, not a judicial matter."

"So, obviously the CDC will abide by the order of the court because it’s a legal obligation," he continued. "But one of the problems that we have there is that the principle of a court overruling a public health judgment by a qualified organization like the CDC is disturbing in the precedent in might send," Fauci concluded.

Rep. Dan Bishop, R-N.C., responded on Twitter, "What’s ‘disturbing’ is that Fauci and the bureaucrats think they are above the law."

Conservative radio host Mark Davis tweeted, "Stupidity or willful blindness?  The #CDC is entitled to whatever opinions it wishes; it does not have right to impose them through law into the interiors of aircraft." 

He added, "This is why #JudgeMizelle was right; none of this is about anyone’s view of masks.  It’s about the rule of law."

West Virginia Attorney General Patrick Morrisey, R-W.V., tweeted, "Fauci may want to take a little time and review the Constitution and the case law. The CDC must follow the law just like any other agency or person." 

Morrisey then wrote, "We must fight against the woke-left which appears hell bent on using Covid to control people as long as possible. #NoToFauci."

Conservative podcaster Bryan Dean Wright asserted via Twitter, "The CDC wants power. That’s it. That’s what this is about."

Conservative radio and podcast host Derek Hunter asked, "Does @costareports understand how the law works?" He then wrote, "The decision had nothing to do with efficacy, it had to do with whether or not the CDC had the authority. Chemo exists, the state doesn't have the power to mandate you take it. And that's being generous to the idea that masks work."

Other conservatives responded to a similar Fauci interview with Kasie Hunt Thursday during which he claimed to be "both surprised and disappointed" about the court ending the travel mask mandate this Monday, "Because those types of things really are the purview of the CDC." 

Former Intercept journalist Glenn Greenwald tweeted, "This is either very ignorant or very deceitful from Fauci. Of course it's CDC's job, not a judge's, to make public health policy. That wasn't what the judge was doing. She was ruling on the legal limits and scope of CDC's power. And that's the job of a judge to do, not the CDC."

And The Federalist Editor-in-Chief Mollie Hemingway wrote, "Fauci seems to assert that the bureaucracy should not be beholden to the Constitution and rule of law."

I guess I should stop being surprised what people write here, but defending Fauci's argument  that Courts shouldn't  have the power of judicial review over  federal policy so long as scientists support the policy (or, at least, Fauci does)  is not one I expected to see.  Attacking our system of three branches of divided government is pretty routine for some on the left these days, I guess.

He, and others, think the CDC is above the Constitution and rule of law.

If the CDC were above the Constitution and rule of law, why does he say

He was asked what he thought personally about the decision, not what he thought about the CotUS or the rule of law. The only thing I see here is people taking something said, mischaracterizing it, and throwing up a straw-man argument against what they said he said, purely to make political points with their base. Or, to put a point on it: They are lying.

The answer to that is simple. The masks never worked, and educated people learned that in 2020. In fact, they actually caused harm, because masked humans inhale their CO2, sneeze into their masks, and constantly touch/readjust their masks with unsanitary hands. 6.)  On Easter   Dr. Fauci suggested President Trump.   should have shut down the economy   in February… When the number of known cases in the US was around 100. Fauci later walked back his attacks.

10.)   Dr. Fauci and the CDC missed   themillions and millions of US citizens who had already contracted the coronavirus before the draconian lockdowns took place. Knowing this could have prevented the economic calamity.

11.)   On April 15, 2020 ,   Fauci endorses Tinder hookups , unbelievably.

12.)  Dr. Fauci   relied on corrupt W.H.O rules to lock down the United States and destroy the US economy.   Meanwhile, this   delays the herd immunity   that is needed to prevent a future outbreak of this deadly virus.

When law 42 cfr 70.x came out 50 years ago. Some of the rules were finalized in 2017 under the Trump admin. Under the law the Director of the Health and Human Services has directed the CDC to carry out and enforce those rules.

The Legislative branch empowers the Executive branch to make regulations all the time. The regulations have the authority of law, can be enforced by agents of the Executive branch, and violators can be prosecuted. That aspect of their authority was not even in dispute in this case.

The Executive branch CAN NOT pass laws by itself.    The Legislative branch can.  If you don’t understand that, you don’t understand one of the key concepts this great country was built on.    Separation of Powers.

The mask mandate is an exercise of power granted to CDC by Congress. The opinion overruling that authority is not a good one.

The CDC’s power to make this regulation derives from a law passed in 1944 called the Public Health Service Act . This law, which has been recently updated, defines all sorts of power and authority for the health officers and agencies of the federal government. The part of this law that was of concern in this case is below. Note the empowerment to make and enforce regulations.

The main word at issue was “sanitation.”

PART G—QUARANTINE AND INSPECTION CONTROL OF COMMUNICABLE DISEASES
SEC. 361. ø264¿ (a) The Surgeon General, with the approval of the Secretary is authorized to make and enforce such regulations as in his judgment are necessary to prevent the introduction, trans- mission, or spread of communicable diseases from foreign countries into the States or possessions, or from one State or possession into any other State or possession. For purposes of carrying out and en- forcing such regulations, the Surgeon General may provide for such inspection, fumigation, disinfection, sanitation , pest extermination, destruction of animals or articles found to be so infected or con- taminated as to be sources of dangerous infection to human beings, and other measures, as in his judgment may be necessary.

The CDC sees the mask mandate as a sanitation measure to prevent the spread of Covid. Seems straightforward enough. I wouldn’t think that would be particularly controversial, but the judge took it upon herself to define the word according to her own narrow preferences, ignoring what the medical experts had to say about it. She decided “sanitation” could only mean cleaning up something, even though she found a dictionary that said it had broader application. She decided all by herself to toss any definitions related to preventing the spread of disease.

"Wearing a mask cleans nothing. At most, it traps virus droplets," . . .  "But it neither 'sanitizes' the person wearing the mask nor 'sanitizes' the conveyances."

This is deeply stupid. If sanitation couldn’t be meant as useful to “ prevent the introduction, transmission, or spread of communicable diseases,” it wouldn’t be in the freakin’ law.

And then there is always the part about “other measures” that “may be necessary” - not in the judgment of a judge, but in the judgement of the Surgeon General.

While this was a tortured, ridiculous reason for disallowing the mandate, I believe it could have easily been overturned by other reasoning. The mandate was ordered by the Biden administration as an emergency. That defies logic because the situation had already existed for a year. Normally, a regulation like this cannot be implemented without public comment. The emergency declaration bypassed that requirement. Holding CDC accountable on the grounds of process would be a far better legal justification than trying to redefine “sanitation.”

Thankfully I attended a more enlightened school district.

In grade school our basketball coach also taught us the sciences.

He inspired many of us to 'do the research' (back before computers).

Have earned a few college degrees that I credit to his teaching skills.

He taught us that learning was fun. Thanks coach!

Later learned that advanced knowledge was profitable as well.

He made every science class after grade school seem easy.

A firm grasp of the basics in grade school was my Sci.101.

Aced all of my college classes due to a solid background in the basics.
