TOLEDO, Ohio — President Joe Biden could be left off the ballot in Ohio this fall unless the state's Republican-dominated legislature creates an exception to the ballot deadline or the Democratic Party moves up its convention, according to the office that oversees the state's elections.

Ohio's deadline to certify presidential candidates for the general election is Aug. 7, nearly two weeks before the Democratic National Convention, at which Biden is expected to be nominated to run against Republican challenger Donald Trump.

Ohio law requires that presidential candidates be certified 90 days before the general election, which is on Nov. 5 this year, said a letter written last week by Paul DiSantis, chief legal counsel for Republican Secretary of State Frank LaRose.

"Please contact me as soon as possible with any information that can assure this office of timely compliance with Ohio law," the letter said.

The Biden campaign said Monday that it does not expect the snag to keep the president off the ballot.

"We're monitoring the situation in Ohio, and we're confident that Joe Biden will be on the ballot in all 50 states," the campaign said in a statement.

A similar situation came up before the 2020 presidential election. In that case, both the Republican and Democratic conventions were scheduled outside the deadline window so Ohio lawmakers approved changing the cutoff to 60 days — but only for that election.

The letter sent to Ohio Democratic Party Chair Liz Walters said that the legislature would need to act by May 9 to create an exception to the 90-day deadline or that Democrats would need to move up their convention, which would seem unlikely.

Messages seeking comment were left with Walters and the state party on Monday.

Trump won Ohio in 2016 on his way to the White House and won it again in 2020, when he lost to Biden, becoming the first losing presidential candidate Ohio had supported since it sided with Richard Nixon over John F. Kennedy in 1960.

Instead Republicans in the Ohio Legislature will beg, plead, and cajole Brandon and the DNC into eventually writing requesting an extension; and then pass a bill extending. The entire leadup to the written permission will be treated the same Democrats using lawfare to go after Trump; and keep independents off the ballot by the media. I just illustrated how it is essentially impossible for two presidential candidates to be seen as equal in terms of good/harm to the nation.   There is always a difference.   And in the case of Trump and Biden the differences are profound.

It is ridiculous to imply that a rational adult cannot make a determination as to which of the two would be worst/best for the nation.

One can always offer which they hold as worse (or best) and provide reasons why they hold that opinion.

That was not the point.

The point is that it is basically impossible to hold that Trump and Biden are equal.   There are differences ... profound differences.   Those two men will take the USA in very different directions.  

One of them will be the PotUS.   If you had the power to pick which one (but only out of those two), I doubt that you would throw up your arms and claim that you cannot decide.

This law has been in place since 2014. I don’t know what the deadline was before that. In 2020, both parties held their conventions in late August, so this is not new scheduling. Apparently Ohio made an exception that year. Going back several elections, a number of conventions have been held in late August, and even in September.

Now that’s curious. Apparently, if you engage in Insurrection, in violation of the 14th Amendment (according to your state Secretary of State, and a state court), you can’t be left off the ballot because that would constitute interfering with a federal election.

But if your convention is a little late, Ohio can keep you off the ballot.

That might be harder than you think. The law on insurrection reads as follows:

Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.

So, if a person engages in insurrection, incites insurrection, or assists insurrection, he is guilty of insurrection. That’s pretty circular. None of this explains what insurrection actually is legally. Usually, you can read a law and find the elements required to prove violation of the law, but this law just says you’re guilty of the crime if you commit the crime.

In cases like this, the courts end up defining the crime. I.e. Act A is insurrection, but Act B is not. Then, you make the argument that in the case at bar, the alleged behavior more closely resembles Act A than it does Act B. These vagaries are why I think Trump has not been - and never will be - charged with insurrection. The events of January 6 are entirely unique in American history.
