Let's see what have we here... is it fake news? A peaceful protest, just an afternoon tour, let in by the Capital Police with hugs and kisses or it never happened. I lose count of the lies.
I suspect the vast majority will only be charged with trespassing...and time served.

I read a similar article at CBS news on July 29 , indicating 550 charged with various crimes related to the riots and storming of the Capitol on Jan 6, 2021. And I also noticed that they did not use the word "insurrection" or "insurrectionists" at all in that article. Indeed per your seeded article and the CBS article it appears that nobody has yet been charged under 18 US Code 2383 - Rebellion or Insurrection. Yet many news outlets continue to use those words in describing the riots that took place that day.
I am not a lawyer (although I did stay at a Holiday Inn Express last night), so I am just wondering why if so many continue to call it an insurrection then why haven't any of the perpetrators yet been charged with that specific Federal crime? Not saying they shouldn't be, just wondering why they haven't been, and why people keep reporting it as though they have. Your thoughts?
Because the prosecutors have said, even though they agree it's insurrection, it's a very high bar to reach with jurors. There are some Proud Boys and some Oath Keepers being charged with conspiracy though.
I suspect most of those charged were simply on the premises. Unless there is visual or audio evidence of a crime being committed, other than trespassing, most will go free or only charged with misdemeanors. Jurors tend to be fair when real facts are presented to them, and are usually not influenced by hyped up sound partisan rhetoric.
Not as high a bar as say “sedition”. To the extent that some of them were organizing and colluding, sure seems to me like 18 US Code 2383 would apply. I know it hasn’t been used since the Civil War, but if it fits the crime I think it should be used here if for no other reason than to discourage such a thing from happening again.
Any Sedition charges would be filed on those that spoke at the "rally". Not those storming the Capital Building.
We have allegations of organization of a couple of small groups - plea deals for being state's witness, but we don't have any proof of collusion. I suspect that would be what the House Committee is supposed to be looking into, but instead it's a political circus. Or maybe something will come out in one of the court trials if any go that far.
No kidding. If the prosecution really feels they have a case that fits the definition of insurrection as put forth in 18 US Code 2383, then they should level those charges. I don’t understand why the circus in Congress or congressional committees should make any difference.
I believe the Justice Department is the primary agency tasked with enforcing US Code, particularly section 18. So seems to me that they should be the ones determining what the appropriate charges should be in this matter, not a Congressional committee, and certainly not the media.
The wording of 18 US Code 2383 is a bit vague and certainly open to some interpretation, but sure seems to fit with what some of the rioters had done, especially if their stated goal was to overturn the results of a Federal election.
599 arrested. And none from Mar-a-Lago, The Congress, The Senate or Bedminster.
None of those arrested was BLM or ANTIFA either!
