Federal Judge Overturns Biden Admin's Repeal Of Trump-era 'Remain In Mexico' Border Policy
Progressives have long sought the end of the policy, but Biden's attempts to do away with it have hit a legal roadblock.

A federal judge has overturned an attempted repeal by the Biden Administration of a border policy instituted during the presidency of Republican Donald Trump. The policy requires immigrants and asylum seekers to remain in Mexico while awaiting their immigration court proceedings.

Biden had sought to repeal the policy in a June 1 memorandum, however, the states of Texas and Missouri quickly filed a lawsuit for an injunction.

On Friday, the U.S. District Court for the Northern District of Texas has placed an injunction against the Biden Administration. The injunction requires anyone acting under the administration's command to continue to comply with the Trump-era policy.

It's better than what's been happening since January 20, 2021. Maybe now the Delta and Lambda variant surges, among other things, will decrease, too.

The ruling accuses Mayorkas of not having addressed the problems created by false asylum claims, that it discouraged migrants from traveling, or that DHS had previously found that 9 out of 10 asylum claims from Northern Triangle countries are ultimately found not to have merit.

The ruling also accused Mayorkas of not having considered warnings that ending MPP would lead to a surge in migrants crossing the border, and that he didn’t consider the costs to the states. Kacsmaryk also said he found DHS arguments, such as the potential negative effect on diplomatic relations, "unpersuasive."
