Special counsel Jack Smith said Monday that he is   dropping his election subversion case   against President-elect Donald Trump, seeking the case’s dismissal in a court filing with the judge.

Trump has said he would fire Smith once he retook the office, shattering previous norms around special counsel investigations.

“The (Justice) Department’s position is that the Constitution requires that this case be dismissed before the defendant is inaugurated,” Smith wrote in a six-page filing. “This outcome is not based on the merits or strength of the case against the defendant.”

Smith’s criminal pursuit of Trump over the last two years for trying to subvert the 2020 presidential election and his mishandling of classified documents represented an extraordinarily unique chapter in American history: Never before has a former occupant of the White House faced federal criminal charges.

Though the election subversion case culminated in a landmark Supreme Court ruling this summer that said Trump enjoyed some presidential immunity from criminal prosecution, Trump’s strategy of delay in the case ensured that a trial never got underway before the election.

They should never had been brought in the first place.

It is common sense to know that if Trump did not run for president, these cases would never have been filed. The whole idea was to make him obsolete on the political arena and force him to drop out. Then the cases would have been dropped.

Are you aware of the elements of a cause of action for malicous prosecution, which is a civil claim, although applicable to both civil and criminal actions?  What facts in these two cases fit within the elements of a malicious prosecution cause of action?

The Justice Department's position

The Justice Department's position is merely a policy position adopted by the Justice Department.  It is NOT the law.

Dismissal with prejuduce means the charges can be brought up again.

That is incorrect.  A dismissal without prejudice means criminal charges, or a civil claim, can be brought up again, if it is done within the statutory limitation period.  A dismissal with prejudice means charges cannot be brought up again without an appellate ruling to the contrary.

Yes, I’m disappointed in Merrick Garland, Jack Smith, & SCOTUS. But mostly I’m disappointed in the 76 million Americans who said “no big deal” and voted for a candidate who, just 4yrs ago, lost an election, refused to concede, and then actually committed crimes trying to overthrow that election.
