Texas AG threatens to prosecute doctors in emergency abortion

Texas Attorney General Ken Paxton on Thursday threatened to prosecute any doctors involved in providing an emergency abortion to a woman, hours after she won a court order allowing her to obtain one for medical necessity.

Paxton said in a letter that the order by District Court Judge Maya Guerra Gamble in Austin did not shield doctors from prosecution under all of Texas's abortion laws, and that the woman, Kate Cox, had not shown she qualified for the medical exception to the state's abortion ban.

"Fearmongering has been Ken Paxton's main tactic in enforcing these abortion bans," Marc Hearron, senior counsel at Center for Reproductive Rights, which represents Cox, said in a statement. "He is trying to bulldoze the legal system to make sure Kate and pregnant women like her continue to suffer."

The government of Texas literally heard from a woman, a citizen, who fears for her life and her future ability to "populate" the state with additional children and the state sided with her loss of this child through leaving the state (may be even for good)! It's a clear demonstration of Texas government 'controllers' not being interested in the life of the mother or her future off-spring over a pretense that every child (unfit or fit) matters!

The business of Texas is business, especially the oil business. While there are beautiful spots in the giant state, its cities are hellscapes. Dallas is a sprawling megalopolis. Houston is a swampy speedway. No, they don't have a state income tax, but they make up for it in monstrous property taxes, sales taxes, fees and surcharges. Services are few and far between. Now though, Texas has become oppressive. Been there, done that. I would never live there for love or money ever again!

Yes, republicans want to micromanage personal rights and voting rights according to the Bible, with Abbott's cronies including the AG they did not have the guts to convict.

Texas Supreme Court Halts Judge’s Abortion Approval

Web December 9, 2023, 6:18 AM PST Texas Supreme Court Halts Judge’s  Abortion Approval  Ryan Autullo Correspondent Stay caps whirlwind week in legal challenge to  abortion  …
.
Seems to me that Texas wants a kid who's going to die and a mother to suffer.  Has that State decided to return to the Middle Ages?   She should move to Canada where abortion has been a common sense issue for the past 35 years.
Abortion is the premature ending of a pregnancy. Inducing an abortion was a  crime  in Canada until 1988, when the  Supreme Court of Canada  struck down the law as unconstitutional. Since then, abortion has been legal at any stage in a woman’s pregnancy. Abortion is publicly funded as a medical procedure under the  Canada Health Act ..

Interesting read from the Texas Supreme court.

Excerpt: A pregnant woman does not need a court order to have a lifesaving abortion in Texas. Our ruling today does not block a life-saving
abortion in this very case if a physician determines that one is needed
under the appropriate legal standard, using reasonable medical
judgment. If Ms. Cox’s circumstances are, or have become, those that
satisfy the statutory exception, no court order is needed. Nothing in this
opinion prevents a physician from acting if, in that physician’s
reasonable medical judgment, she determines that Ms. Cox has a “life threatening physical condition” that places her “at risk of death” or
“poses a serious risk of substantial impairment of a major bodily
function unless the abortion is performed or induced.”

It seems there is a difference between "doctor’s mere subjective belief" .   and "doctors reasonable medical judgment” .

So the state legislature will become the final arbiter in these cases? So much for doctor/client privilege. So much for limited government interfering in our lives. So much abject intolerance. So little empathy.

So the state legislature will become the final arbiter in these cases?

Not really. The legislators should be writing the laws in a clear enough way where the courts are not needed.  In this case it seems the supreme court decided there was an issue with the doctor not meeting the "doctors reasonable medical judgment” when saying it was the "doctors belief" an abortion was needed.  That is still between the doctor and patient.  It seems a bit nit picky in the wording to me but I am not a lawyer.  It seems if the doctor said it was their reasonable medical judgement even after the judgement came down they could have proceeded with the abortion in Texas.

Nit picky?

Cox was compelled to cross state lines to endure a procedure that she certainly didn’t anticipate nor hope for. It became her reality when her state legislature, state officials, and state courts failed her in their ‘nit pickiness’.

Who knows what she faces going forward as she tries to regain her life in the spotlight of such intolerance for a woman’s privacy?

Nit picky?

Yes, nit picky as described above.  It seems the Supreme court interpreted the  law looking for a specific wording to allow an abortion for medical reasons that were not supplied.

Cox was compelled to cross state lines to endure a procedure that she certainly didn’t anticipate nor hope for. It became her reality when her state legislature, state officials, and state courts failed her in their ‘nit pickiness’.

Based on what the Supreme court said I am not sure she had to leave.  The courts interpreted the law.  That is their job, not to make the law.

In her specific case the legislature did not make a law that was in her best interest at this time.  If enough people don't like the law and it is important enough for them they can vote the legislators out.  I don't know anyone is happy with all the laws they have to obey, that is why we have elections, so some of the laws can be changed.

If she is not allowed to abort, there is a chance she'll miscarry, with the resulting dangers of a late miscarriage.  It's also possible she'll require a c-section to deliver if the pregnancy progresses.  She's already had several c-sections.  Multiple c-sections increase the chance of uterine rupture in subsequent pregnancies, and that can be fatal.

If Ms. Cox or the product of the pregnancy dies charge the AG with man slaughter.  ( the crime of killing a human being without  malice  aforethought, or otherwise in circumstances not  amounting  to murder.)

Another charge could be terroristic threat (A terroristic threat is  a threat to commit a crime of violence or a threat to cause bodily injury to another person and terrorization as the result of the proscribed conduct .)

Could Paxton have committed political suicide or does he know that Texas voters would still support him as AG or the GoP government because the majority of them are as cruel as he or it is?

I don't see the NT members who hold themselves out by their user names as being from or supporters of Texas commenting on this seed.  I wonder if it has embarrassed them.

This is disgusting. Someone I hold near and dear to me had to have an abortion because of a trisomy 18 defect. It was the worst moment of her life. Why are they forcing a woman to give birth to a baby with no nervous system? They are the monsters here.

It is total BS that this will cause the woman to become sterile, but it might cause her undue grief.

Not necessarily.  There is the chance.  She has already had 2 c-sections.  If this pregnancy continues, she may need her third.  Risk of complications such as uterine rupture increase with each c-section, so this could render her sterile, or render future pregnancies more risky.

I should have been more specific. I meant a normal delivery. In this woman's case, she does have a risk, but carrying to term presents a risk, too. That is why it should be left to her doctors and not politicians and courts to decide.

Exactly.  The risks might be worth it for a viable pregnancy.  She doesn't find the risks to be worth it for a pregnancy that may result in miscarriage or stillbirth, and at best will result in a child that can't survive, and that decision should be hers, not Paxton's.

The obvious answer is it NEVER should have come to this. I mean talk about the amount of OVER-EXPLAINING and ACCUSATORY ATTITUDE on this display here as this woman is being treated like she has done or is willing to "do" something wrong.

Now then some conservatives like to admonish liberals about VIRTUE SIGNALING and here they are in a 'model' conservative-led state signaling their political behinds off on what is right and wrong for girls and women who are healthy. . .and want to stay that way!

I don't understand what Paxton is doing here, but pandering to hard core anti-women voters. He's not protecting the life of a potential child, or the mother. He's not protecting the law as it was written as the judge made clear this only applied to this one and only case. How does this, in any way, help the people of Tx?

I read that news when I woke up a few hours ago, and what went through my head is that if any woman in Texas is stupid enough and submissive enough to vote Republican at the next election there (but maybe the Republican government will take away the right for women to vote, next) they deserve to spend the rest of their lives as "Handmaidens" pregnant and barefoot and in the kitchen, but then maybe they would like that.

MAGA is so full of BS. I have been thinking about several points of interest: No gun control. No abortion. No birth control. No affordable health care, no mask wearing, no vaccinations, no DEI, no ("doable")  immigration policy, no same-sex marriage, no marriage equality, no [list here] and so forth and so on.

MAGA stands for NO (anything) that liberals and secularists wish to see occur in our country.

Independent voters need to seriously take a good look at MAGA/Trump because there are and will continue to be a stream of unfulfilled people and left out citizens if/when the GOP gets renewed control over the country!

The GOP is the party of MAGA and Trump is the head of MAGA and MAGA does want: Gun control, abortion, birth control, affordable health care for the citizenry, people to mask up during pandemics, wants vaccinations, DEI, "do-able" immigration policy, same-sex marriage, marriage equality, and so forth and so on.

Come on GOP/MAGA own your BS already! Moreover, this year I resolve not to spend a lot of time in back and forth where GOP/MAGA denies the truth even about itself!

MAGA shit or get off the pot already! Y'all hang out here all the time saying little to nothing about MAGA in explanation of what it is or what it wants in compromise (no compromise) - so it is what it is. I will call it as I see it.

Oh, and No MRNA vaccines. . . MAGA is calling for a halt in those vaccinations too.

Another car metaphor in the campaign reminiscent of the Obama metaphor about republicans driving the car into a ditch!

"After they drove the car into the ditch, made it as difficult as possible for us to pull it back, now they want the keys back," Obama said of the GOP. "No! You can't drive. We don't want to have to go back into the ditch. We just got the car out."
