A judge's order

A few days ago, an Obama judge, Chief U.S. Judge James Boasberg granted a temporary restraining order halting the deportation of five Venezuelan nationals cited in a lawsuit brought by two leftwing organizations, Democracy Forward and the American Civil Liberties Union. The order followed President Trump's proclamation, signed the day before, targeting Tren de Aragua members for immediate deportations under the Enemies Alien Act. The President invoked the Act out of safety concerns for US citizens. The Act allows for the deportation of non-citizens without a hearing. Since Saturday, Boasberg expanded his restraining order to a class action and extended the temporary restraining order to all noncitizens in the United States covered in Trump's invocation of the Alien Enemies Act.

There are serious questions about District judges going beyond their authority to interfere with Executive branch policies. It appears that the left is using these courts and judge shopping to resist Trump policies.
This particular judge  is the same judge accused of a long list of overreach & political bias in cases on the border, Trump-Russia, January 6, US energy and more: This judge ordered the shutdown of the Dakota Access Pipeline in March of 2020. He was partially overturned on appeal. He blocked New Hampshire’s Medicaid work requirements in 2019. He barred ICE from detaining asylum seekers for more than 7 days so ICE could check potential criminal backgrounds in 2018. He was notorious for imposing prison sentences decried as excessively harsh and politically motivated on Jan 6th defendants. He sent even non-violent offenders to prison. He also endorsed the use of the Enron statute, which legal pros criticized as stretching a corporate fraud statute until it snapped to charge defendants with obstructing an official proceeding (Congress’s certification of the 2020 election).  Boasberg sentenced FBI lawyer Kevin Clinesmith to probation rather than prison for altering an email during the Trump-Russia investigation in order to speed up FBI spying on the Trump campaign. 


Some democrats are claiming that Trump ignored the judge's order that planes in the air with deportees be turned around. The White House denied that it had violated the order, saying that the president had broad powers to deport the migrants under an 18th-century law and that the federal courts had no jurisdiction over his power to expel foreign enemies.


House Republicans are now considering impeaching radical judges who are exceeding their authority in trying to resist Trump policies:

Rep.  Eli Crane  (R-Ariz.) said he is drafting articles of impeachment against Judge Paul Engelmayer of the Southern District of New York, who in a ruling last weekend temporarily restricted Musk and DOGE aides from accessing a Treasury Department payment system.

Rep. Andrew Clyde  (R-Ga.) is working on an impeachment resolution against Rhode Island District Judge John McConnell Jr. over his ruling halting the Trump administration’s freeze on federal funding.

And Rep.  Marjorie Taylor Greene  (R-Ga.), chair of the House Oversight Delivering on Government Efficiency Subcommittee, pledged in a hearing this week while referencing Engelmayer that “We will hold this judge and others who try to stop the will of the people and their elected leaders accountable.”

With over 100 lawsuits filed with leftist district judges, it is high time that the SCOTUS steps in and ends the resistance. The jurisdictions of all these judges are overwhelmingly in democrat districts. They have no authority over hiring and firing of federal employees. They have no authority over immigration decisions. As we discovered in Trump's first term, they also have no authority over bans that a President may place on terrorist/rogue states.

All are executive branch decisions. The SCOTUS must put a stop to it or congress needs to impeach the out-of-control district judges.
