Trump Administration Preparing National Emergency Order That Identifies $7 Billion For Border Wall
President Trump has tried to go through every legislative option to fund the border wall and reopen the government, but the obstructionist, name-calling Democrats who live in mansions guarded by walls, have refused to fund a physical barrier on the US border. Those same politicians gave Tunisia money to fund a wall on the Libyan border, so why is that wall worth funding and one on the U.S. border not? The Government is in its 34th day of being shut down as Democratic lawmakers who have walls around their homes, refuse to fund a wall on our southern border, but voted to fund a wall on the Tunisia Libya border.

After making offer after offer, compromise after compromise, and proposal after proposal, the administration has come to the realization the only way to actually address the humanitarian and national security emergency on the border is to declare a national emergency and to fund the wall. Something President Trump has the full legal authority to do.

President Trump has tried to go through every legislative option to fund the border wall and reopen the government, but the obstructionist, name-calling Democrats who live in mansions guarded by walls, have refused to fund a physical barrier on the US border. Those same politicians gave Tunisia money to fund a wall on the Libyan border, so why is that wall worth funding and one on the U.S. border not?

The administration for weeks has been considering whether to declare a national emergency, but CNN  is reporting that the Trump administration has drafted an emergency proclamation.

“The massive amount of aliens who unlawfully enter the United States each day is a direct threat to the safety and security of our nation and constitutes a national emergency,” a draft of a presidential proclamation reads. “Now, therefore, I, Donald J. Trump, by the authority vested in me by the Constitution and the laws of the United States of America, including the National Emergencies Act (50 U.S.C 1601, et seq.), hereby declare that a national emergency exists at the southern border of the United States.”

The administration has entered the 34th day in the shut down as the Democrats refuse to fund the wall, and Trump again was warning the Democrats he would use the authorities granted t0 him by the National Emergencies Act.

“I have other alternatives if I have to and I’ll use those alternatives if I have to,” the President said. “A lot of people who wants this to happen. The military wants this to happen. This is a virtual invasion of our country.”

Many Democrats only argue that the crisis at our border is manufactured and that is why he doesn’t have the authority to declare a national emergency.  U.S. Immigration and Customs Enforcement , the same ICE that Democrats want to abolish, last year seized enough fentanyl to kill every single American.

In 2014, the Huffington Post reported a heartbreaking reality that the absolute majority of women who make that dangerous journey face. 80% of women and girls are raped as they are trafficked to the US Mexico border. Women and girls in Central America are given contraceptives because of the very high likelihood they will be raped.

The Border patrol has to refer, on average, 50 cases a day to medical providers and sadly we have seen the negligence of parents of illegals lead to the death of gravely sick children.

ICE has arrested 266,000 arrests of criminal illegal aliens, with 100,000 assaults, 30,000 sex crimes, and 4,000 murders, and tens of thousands of other crimes.

The porous border has been a gateway for drugs, terrorists, gangs, and human traffickers to inflict absolute misery on the immigrants and the American people, it is a national emergency. If the crisis in Burundi is an emergency then the crisis at our own border is sure as h*ll an emergency.

The President under the National Emergencies Act has to inform Congress of the planned emergency, and Congress, if it can get a 2/3 majoirty in both houses, can overrule it.

The Brennan Center Justice at NYU identified many provisions of law giving the President a range of different powers and it said

Under the powers delegated by such statutes, the president may seize property, organize and control the means of production, seize commodities, assign military forces abroad, institute martial law, seize and control all transportation and communication, regulate the operation of private enterprise, restrict travel, and, in a variety of ways, control the lives of United States citizens.

The Immigration and Nationality Act  allows for President Trump to tap into an emergency fund pertaining to combatting illegal immigration but the total there in its own right is a small 20 million.

The Army Corp of Engineers under the powers of the national emergencies act has full authority to build projects that the US Congress has voted for in the past with the Secure Fences Act of 2006 a bill that Senate Minority Leader Chuck Schumer proudly supported.

The President will face a legal battle against this as the Democrats will take it to the Supreme Court, he must have one of his state AG allies sue the administration on this in a court that is friendly to conservatives.

.....CRS, Congress’s in-house research arm, internally published a paper Jan. 10 titled “Can the Department of Defense Build the Border Wall?,” which The Daily Caller News Foundation has obtained. It says (emphasis added):

Another statute that authorizes the Secretary of Defense to assist civilian law enforcement with counterdrug activities may provide some authority for the construction of barriers along the border.  10 U.S.C. § 284  (Section 284) provides that the Secretary of Defense “may provide support for the counterdrug activities or activities to counter transnational organized crime” of any law enforcement agency, including through the  “[c]onstruction of roads and fences and installation of lighting to block drug smuggling corridors across international boundaries of the United States.” …
Use of Section 284 would  not  require a declaration of a national emergency  under the NEA. However, the DOD’s Section 284 authority to construct fences appears to extend only to “drug smuggling corridors,” a condition that may limit where DOD could deploy fencing.

“Drug corridors” are not defined in law, according to a congressional aide......

I’m sure that there are many areas along the border that could qualify for that designation.  Build the border barriers!

What Crisis ?

U.S. Customs and Border Protection data show that in March 2017 agents made 12,193 apprehensions at the U.S.-Mexico border. It is the lowest number in at least 17 years , according to monthly southwest border apprehension numbers since fiscal year 2000.

Apprehensions at the southwest border peaked in 2000 at 1.6 million (yearly total) but began a declining trend during the 2008-09 recession that has continued since, Mittelstadt said.

Apprehension data is generally used as a metric to measure illegal immigration.

Trump isn’t the only one who has said the numbers are declining; Democrats have cited the same point.

Trump said illegal immigration on the U.S.-Mexico border is "the lowest in 17 years."

Border Patrol data support Trump’s claim. In March, Border Patrol recorded 12,193 apprehensions at the southwest border, the lowest in at least 17 years.

Overall, we rate Trump’s claim True.

If an emergency order did go through, the money would apparently come from disaster funds.  But we already know that Trump doesn't give a crap about helping Americans after disasters; just look at Puerto Rico, and his comments about denying FEMA funds to California after scores of people were killed in a fire (he couldn't even be bothered to learn the name of the town that burned, that psychopathic bastard).

It is a crisis and the emergency will be declared Feb. 16 if no other suitable deal before then.

Venezuela is an interesting situation.  Will our progressives side with the democratic freedom forces there and president Trump or will they side with a socialist dictator and his Russian and Chinese benefactors?

Seems to me it could be settled by having another election but I suppose that would be too easy, for everyone.

IF we found a real reason to get in on this I would think that would be the objective, not to support one over the other but to get a new election. The fact that the "new" President had to swear HIMSELF in and the fact that U.S. oil companies are real interested in getting that country's oil makes me wonder about why we're so interested.

I'm also not sure how much of what we're hearing is from U.S. intel and how much is from Venezuelan propaganda.

It's real easy to stir trump up with right-sided propaganda, easier yet to stir up a good portion of his base with it. Just the word "socialist" is enough already. Get a nice dictator in, the U.S. knows how to make deals with them, socialists are more unpredictable.

IF China AND Russia are also "involved" does this mean we're starting the cold wars up again?

yep, will trump encourage more dissidence there to prop up his border crisis here or will he do want he can to help discourage their problems instead. We'll see.

I'd say that depends on what congress does soon about the trump wall.

Yep certainly an interesting situation.

The detection and seizure of over 250 pounds of that new highly lethal drug at the border the other day and the use of illegals as human mules to carry drugs across the border justifies any such designation.
