Capitol rioter gets 41 months in longest Jan. 6 sentence

A former mixed martial arts fighter was   sentenced   to 41 months in prison Wednesday after pleading guilty to assaulting a police officer, a felony charge stemming from his participation in the Jan. 6 Capitol riot.

Why it matters:   Scott   Fairlamb, 44, is the first Jan. 6 rioter to be ordered to serve years behind bars. The sentence could set a benchmark for other cases that prosecutors have brought against people involved in the attack.

What they're saying:   Ahead of the sentence, Judge Royce Lamberth told Fairlamb, of New Jersey, that pleading guilty was the right decision, adding that "had you gone to trial, I don't think there's any jury that could have acquitted you," per   CNN .

  • "It is clear that Mr. Fairlamb is not a danger to the community," Fairlamb’s lawyer wrote in a   sentencing memo .
  • "He is sincerely remorseful and will never repeat the crimes to which he pled guilty," he added.
  • "Mr. Fairlamb has a family ready to provide strong support for his return as a law-abiding and productive member of society.

    The backdrop:   Prosecutors had sought 44 months in prison for Fairlamb, who shoved a police officer and punched his face shield. Federal sentencing guidelines for similar offenses suggest between 41 and 51 months in prison.

    • Fairlamb had a criminal record before the insurrection attempt, which included two past convictions for violent assaults, according to the   sentencing memorandum .

  • Why did he repeat the crimes against the LEO...Cuz he is a frucking liar.

Seems fair. As a MMA fighter he should know better than to use his skills on the street but with two prior convictions for violent assaults and assaulting this cop now this guy is going where he belongs.

What about the QAnon Shaman who is looking at possibly getting years 4 in prison.

The Justice Department is asking for Jacob Chansley, also known as the QAnon Shaman, to be sentenced to over four years in prison for his involvement in the January 6 Captiol insurrection.

They're calling him the 'flagbearer' for the insurrectionists at the Capitol.

I would have thought this MMA guy should be getting a longer sentence than the QAnon Shaman idiot. The MMA guy actually attacked a Capital Policeman, this idiot only paraded himself thru and made an ass out of himself. I would think that the physical violence should merit a longer sentence than just what Chansley did.

It's not what he did it's who he is, he's well known and has become the Face of 1/6. As you said his only crime was entering the Capitol building, he didn't hurt or threaten anyone and he caused no damage so the recommended sentence is largely a political punishment. Why else would someone get 4 years for Trespassing, he basically followed the crowd through the open doors past security that just allowed him to pass and then waved his flag and howled. He'd be getting 3 1/2 years for wearing his iconic fuzzy horned hat that made him highly recognizable and 6 months for trespassing.

Ironically, if he hadn't gone out of his way to showcase his actions, both during and after 1/6, he would have most likely gotten a token sentence like most of the others.  But because he held himself above the other rioters, he now has to pay more for his actions.

I see that Jacob Chansley  (The QAnon Shaman idiot) got the same 41 month sentence as the MMA guy...   Still think the MMA guy should have gotten a longer sentence as he actually attacked a cop.
