A federal judge dealt several blows Monday to Special Counsel Jack Smith's prosecution of former President Donald Trump for his alleged mishandling of classified documents.

U.S. Judge Aileen Cannon, a Trump appointee, denied the Justice Department's request to keep fillings sealed in the case and she removed two from the record.

She also asked for prosecutors to provide additional information about the continuing use of an out-of-state jury in the case.

You can read the court ruling here:  https://justthenews.com/sites/default/files/2023-08/CannonRuling8-7-23.pdf

The special counsel asked for some materials in the case to be sealed from the public, but Cannon wrote in her brief that the agency's arguments "fail to satisfy the burden of establishing a sufficient legal or factual basis to warrant sealing."

Trump pleaded not guilty to 37 criminal charges in the case. Smith brought additional charges in a supersceding indictment against Trump last month.

Smith has until August 17th to explain why he's using a Grand Jury in D.C. instead of a Grand Jury in Florida.  I'm sure many can speculate and be correct as to why the D.C. Grand Jury.

And they would be quite accurate in deducing the reason(s)

Even a liberal can do it.  It would require them to remove their heads from their 4th point of contact but they can do it.

I know.  I'm giving them far more credit than they deserve.

They need to change the venue to a red state, to make sure Trump gets a fair trial

IMO the judge, owing her gratitude to the person who appointed her, should have, for the sake of at least the APPEARANCE of absolute lack of bias, if not worse, recused herself from the case.  I really have trouble comprehending how Americans can be satisfied with this kind of shit in their judicial system all the way up to the ignoring of ethical standards in the SCOTUS, if in fact there even ARE ethical standards.  I know it's just everyday business in America that politicians are bought and sold, but holy shit, even the SCOTUS judges are and nobody gives a shit.  Has the word "corruption" been deleted from the American language?

If we're going to look at it that way, Smith should have turned down the appointment.  But, here we are.

I don't know anything about Smith, but I do know that judges require a much higher standard of ethical behaviour than prosecutors or lawyers.  They really should be squeaky clean.

Then came the ruling of Judge Michael Erdos:

I n a recent  ruling , a judge in Pennsylvania declared that an election worker is unable to file a lawsuit against former President Trump for his statements that cast doubt on the 2020 election results.

The judge, Michael Erdos,  determined  that these statements are protected by “presidential immunity.” Specifically, Trump’s immunity covered a tweet he posted and comments he made from the White House during a Pennsylvania state Senate committee hearing in November 2020. Trump alleged voter fraud in the election that occurred in Pennsylvania.

“Other legal proceedings may examine the propriety of his statements and actions while he was the President and whether, as the plaintiffs in this and other cases contend, it was this conduct which served as the actual threat to our democracy,” Erdos ruled. “But this case is not the proper place to do so. Here, Trump is entitled to Presidential immunity.”
