A federal judge in North Dakota on Monday temporarily blocked migrants who were brought into the United States illegally as children from accessing the Affordable Care Act (ACA), also known as Obamacare.

President Joe Biden allowed illegal immigrants who were enrolled in the Deferred Action for Childhood Arrivals (DACA) program to qualify for Obamacare last year. DACA protects the illegal immigrants from deportation, along with giving them access to some benefits and a work permit.

The Biden administration's Centers for Medicare and Medicaid Services (CMS) announced the final rule that gave the recipients access to Obamacare in May, but a coalition of 18 Republican-led states have challenged the rule.

U.S. District Judge Daniel Traynor on Monday sided with the states, led by Kansas, and granted a preliminary injunction on the rule. The states had argued that DACA recipients are not considered "lawfully present" in the United States, which is a requirement under Obamacare, per KSNT.

"The authority granted to CMS by the ACA is to ascertain whether an individual meets the requirements for lawful status. It by no means allows the agency to circumvent congressional authority and redefine the term 'lawfully present,'" Traynor said in his ruling, reported by The Hill.

Kansas Attorney General Kris Kobach celebrated the order in a statement, claiming it was a "big win for the rule of law."

"Congress never intended that illegal aliens should receive Obamacare benefits," Kobach said. "Indeed, two laws prohibit them from receiving such benefits. The Biden administration tried to break those laws. But we fought back and defeated the Biden Justice Department."

The CMS said it was reviewing the order but does not comment on litigation. The order will remain in effect until a final decision is made.

What do you think is more expensive - the effect of one person on an Obamacare plan that they pay for, or a bad debt from an emergency room visit?  Is your preferred solution to deny treatment entirely to anyone who is denied coverage and can’t pay cash, since it’s cheaper to just scoop up dead people outside of an emergency room with a bulldozer and dump them in mass graves?

Under the ACA, they aren't authorized.  In the latter, that bill is, as I said, at the taxpayer expense.  No matter how you try to spin it, it's time, money and resources wasted on somebody who is in the country illegally.   

Is your preferred solution 

My preferred solution is to remove them from the country so they can come back in accordance with the law.  Then we are not wasting everything on them.

What is at the taxpayers’ expense?  Are you aware that DACA and poverty are not related?  For all you know these individuals make too much money to qualify for a subsidy, thus it would cost taxpayers nothing.  In fact, their premiums only help fund the program.  I was out of work a while back and my wife made too much money for me to qualify for an Obamacare subsidy, so it made more sense to buy a different plan.  Uninsured people cost society way more money than insured ones when the only place they can go (emergency room) is the most costly alternative for care.

Lol - you think Obamacare is just welfare?  I’m guessing you have healthcare provided through your employer.  Go see how much an Obamacare policy will cost you and if you are eligible for a subsidy.  It ain’t cheap.  Obamacare just gives an option for insurance to those who don’t have the option through employers, which is a huge percentage of our society.  Maybe you need to stop thinking of immigrants as inherently welfare queens.

92% of Marketplace policies are subsidized in 2024.

Obamacare just gives an option for insurance to those who don’t have the option through employers, which is a huge percentage of our society.

Individual insurance plans are just less than 10% of nationwide coverage.

I think the theory is that access to Obamacare works as an incentive for illegal immigration. I don’t if we have data supporting or refuting that, but it makes a kind of sense to me. Does subsidizing lots of Obamacare policies cost more or less than random visits to the emergency room would? I don’t know if anyone knows. 

We definitely need better control of who comes into - or stays - in the country, but if any human being needs emergency medical care, I certainly want them to get it.

DACA recipients are commonly enrolled in college or work as professionals in numerous industries.  Painting them with a broad poverty brush is just as ignorant as ignoring the fact that immigrants pay into a federal entitlement program that they cannot even benefit from.  I don’t get how one can’t have sympathy for someone brought into this country as an innocent kid.  Immigration is a problem, but so is callous disregard for humanity.

By and large ‘they’ were fleeing from an oppressive state.

Imagine, for a moment, feeling so terrified that you would leave your home, your family, and everything you have ever known in an attempt to escape the danger…only to find yourself again being castigated, derided, and subjected to a different, but equally terrifying type of brutality.

‘They’ are human beings…voiceless, powerless, and but political fodder in our rather inhumane capitulations. We should and must be better in dealing with such a multi-faceted problem, or it will continue to dog us for another half century.
