I wanted to title this one: “Calm Yer Tits, Trump Hasn’t Actually Been Impeached” and if I drink a couple more beers I might change it. Yesterday the House democrats voted to impeach President Trump, but today House Speaker Nancy Pelosi says she won’t submit the articles of impeachment to the Senate for a trial. A liberal Harvard law professor says that if Pelosi won’t submit the articles, the impeachment technically never happened. Apparently impeachment is a process that includes actually passing the articles along to the Senate and without that, the impeachment is just democrats throwing the world’s biggest temper tantrum.

Check this thing out that Harvard Law professor Noah Feldman wrote for Bloomberg today:

Trump Isn’t Impeached Until the House Tells the Senate
Now that the House of Representatives has voted to impeach President Donald Trump, what is the constitutional status of the two articles of impeachment? Must they be transmitted to the Senate to trigger a trial, or could they be held back by the House until the Senate decides what the trial will look like, as Speaker Nancy Pelosi has hinted ?

…an indefinite delay would pose a serious problem. Impeachment as contemplated by the Constitution does not consist merely of the vote by the House, but of the process of sending the articles to the Senate for trial. Both parts are necessary to make an impeachment under the Constitution: The House must actually send the articles and send managers to the Senate to prosecute the impeachment. And the Senate must actually hold a trial.

Now get ready for the punchline:

If the House does not communicate its impeachment to the Senate, it hasn’t actually impeached the president. If the articles are not transmitted, Trump could legitimately say that he wasn’t truly impeached at all.

House Majority Whip Steny Hoyer announced on Thursday that the House was taking a break and there would be no votes until at least January 7, 2020. That means no “Impeachmass” for liberals to celebrate and, that for at least now, Trump hasn’t been impeached.

This gets even funnier because Constitutionnaly-speaking, the House is obligated to submit articles of impeachment to the Senate for a trail. If Pelosi refuses to send the articles over, Senate Majority leader could charge her with obstruction of Congress, which is one of the bullshit things democrats impeached Trump on in the first place.

One last observation:

Democratic leaders Nancy Pelosi and Chuck Schumer are saying the articles of impeachment won’t be submitted until Senate Republicans make certain concessions. Doesn’t that qualify as quid pro quo/extortion/bribery? You know, the same thing that democrats accused President Trump of doing and for which they launched their impeachment/coup campaign against him?

Technically, he is not impeached until the Senate holds their hearing/trial and vote to approve the "recommendation/order" of impeachment.  Right now, all they have is the "recommendation/order" from the House that he be impeached.

For Trump to be impeached in the House the House must present articles of impeachment to the Senate. As per the article Trump isn't impeached in the House so long as Nancy doesn't forward them on.

So many folks have really forgotten their Civics 101 class that explains the powers of the House and the Senate.

The Constitution did not vest the House of Representatives with the power to complete any legislative actionapart from its powers provided elsewhere within Article I—to issue rules for its internal governance, to judge its members’ elections and returns and qualifications, and to expel members for disorderly conduct, as provided elsewhere. Even with its “sole” power to impeach, the House may only initiate a legislative action but it must depend on the Senate to complete the job, whether it entails enacting a law or convicting and removing a high-ranking official, such as the President, for serious misconduct in office.

So, please Nancy and children - go back to high school, your freshman year, and revisit your Civics 101 class.  In Impeachment, you guys only RECOMMEND - you do not complete the action - that is the Senate's job.

I think Pelosi is starting to realize how stupid this ploy was. The idea that she had any leverage here is preposterous.   All she has done is undercut the very rationale for the hurried  impeachment process.  

She'll think of some reason that justifies her submitting the documents as soon as Congress comes back after the new year without any action by McConnell in the interim. .

A further punchline is that the House's articles of impeachment (bogus as they are) can be expunged from federal/constitutional/Trump records if Nancy doesn't move her ass on this. Oh, hell no, because those little details don't really matter at this particular moment, we are still in the middle of the process.  Its all over the headlines and news, and it won't go away.  He is impeached by the house.  It may not be completed yet, but he is still impeached until the election until the senate goes through the trial.  Trump is impeached, he knows it and so do the rest of us.  So you stay with the punchline and we will stay in the moment, which is after Trump was impeached by the house and awaits trial.  Trump will always be an impeached president, no matter what happens in the future, in the minds of the world.

Trump will always be an impeached president, no matter what happens in the future, in the minds of the world.

So you don't care about the process then. Not surprised. You have had him convicted in the court of liberal delusion for over two years. Good to know. As long as it helps you sleep at night, who am I to take that away. And I doubt the world gives much of a damn at this point...........or any other for that matter. It has nothing to do with the Senate Leader. It's up to the "House" to elect their own Impeachment mangers to sit down with the Senate and work all that detailing out. The Senate acquitted Bill, and if the trial goes through in the Senate and Trump is acquitted, he too will have been impeached. Until there is a hearing in the Senate though, the impeachment process hasn't been completed so technically he hasn't been impeached

There are several "ifs" ...

If Pelosi doesn't file the House's two (unconstitutional) Articles of Impeachment with the US Senate, Trump is still not impeached. She's put the brakes on the legal process, because she and Schumer are trying to control McConnell's Senate procedures. By law, they're not allowed to do this.

If Pelosi doesn't file the Articles with the Senate soon, Trump's Articles of Impeachment can be legally expunged from federal documents and records.

how is your Christmas going? First one in different house. Feels strange.

It is definitely strange!  Got rid of a lot of old decorations when we moved and didn't get a tree this year (we did light up the big one in the front though).  We had over 2 days straight of rain until yesterday!  It was a record for here too, and we did have intermittent internet problems during that time.  I just see the sun behind the fog now, its the first time in days! 

How are you doing in your new place?  I mostly miss my friends, I lived in California most of my life and left it all there, so taking baby steps to settle in here, its more rural so not meeting people as easily.

The impeachment dies in the House at the end of 2020 if she doesn't. Please do tell what you think the chances of Nancy not sending the articles of impeachment to the Senate really are. In my opinion, the chances that she won't send them, regardless of what Senate Republicans do, is less than zero. Will she try to get something in place before sending them? Of course, but there is simply no way she would just drop the articles of impeachment in the round file as it seems so many of ye gleeful Trump supporters seem to be claiming here.

So, if the odds she won't submit them is less than zero, Trump has been effectively impeached. The votes are in, the trigger has been pulled and there's no stuffing that bullet back in the barrel. To argue about the fact that the bullet hasn't hit it's target yet because the process is slow moving, therefore it might not hit the target, is ignorant at best, and that's being charitable.

It's pretty funny to watch, but don't worry, you'll have another decade or two to whine and cry about Republicans losing all their power before another Republican wins the white house, and decades to come of Democrats throwing the dumb ass impeached Donald in your faces like you did impeached Clinton to them over the last 20 years. Please do tell what you think the chances of Nancy not sending the articles of impeachment to the Senate really are. In my opinion, the chances that she won't send them, regardless of what Senate Republicans do, is less than zero. Will she try to get something in place before sending them? Of course, but there is simply no way she would just drop the articles of impeachment in the round file as it seems so many of ye gleeful Trump supporters seem to be claiming here.

If she was really smart, she'd dely. 

Why?

Because if she sends them to the Senate now, what will  McConnell & the Republican controlled Senate do? There's not the slightest doubt in my mind that they will find Trump innocent of any wrongdoing.

So once the Senate gets them, they will obviously find Trump innocent-- and do it before the election. Then they Republicans can say that Trump was accused of charges in The House, then there was the  trial in the Senate and he was found innocent of all charges.  (And that would be true-- and done according to The Constitution).

In fact that work to Trump's advantage as Democrats has been making accusations all along, but they never went to trial. After the Senate trial Trump can say he finally "got his dayi n court" and was found innocent..

But OTOH, if Pelosi can delay the Senate trial so that its just started during the Election-- then the Democrats could say that its impossible to know how it will turn out (because the trials not over).

So delaying handing it over to the Senate is a smart strategic move.

Yes, President Trump has been impeached

Referencing Article I of the Constitution, the writer notes:

Not a word about how the House must transmit anything to the Senate. Indeed, you could argue — and some have — that the articles don’t need to be sent over and that the Senate could begin a trial without receiving them.

OK, but if that’s the case, then Pelosi’s refusal to appoint managers or send anything at all to the Senate is irrelevant and McConnell can proceed with a trial. If she wants her evidence considered, she’d better get on it.

But what if that's not the case? If that's true then McConnell can't start until Pelosi sends it over.

(I am not familiar with the law-- so I do not know if the trial in the Senate can't start until its sent over-- of if it can start anyway because the Houise vote has been taken).

But, while the House has the Articles of Impeachment, they CAN add to them, provided more findings are proven.

And, as noted on a previous thread, the Articles don't go away with a change of Congress.  The incoming House simply names new leads/managers for the case.
