Yesterday saw more chaos and violence on American universities as university administrators tried to grapple with the very problem they helped to create. The so-called adults who celebrated the "passion" of those who spat at the police and looted and vandalized America during the 2020 riots created what we have been watching for the past 9 days.  In red states the police were called in and campuses were cleared. In other places universities made deals with the antisemitic mobs, in some cases agreeing to award scholarships and teaching positions to Palestinians. A three-day standoff at UCLA ended with police overcoming barricades set up by the mob, which finally ended with 200 arrests. At Columbia University protestors called for the "intifada revolution," chanting, "From the river to the sea, Palestine will be free." At Alabama University antisemitic protestors joined Jewish students in chanting "Fuck you, Joe Biden."

After nine days, Joe Bidens advisers realized it was time for the president to make a statement on the obvious crisis. One could assume that even Joe Biden knew it, since the only news he watches is the Morning Joe propaganda show. Right now, Joe Scarborough is keenly aware that the campus unrest could cost Biden the election.


So, Biden spoke only a few miles from where a statue of George Washington had been desecrated with Palestinian flags & symbols. The president only spoke for 4 minutes.

He said the following:

"There should be no place on any campus, no place in America for antisemitism or threats of violence against Jewish students," Biden said. "There is no place for hate speech or violence of any kind, whether it’s antisemitism, Islamophobia or discrimination against Arab-Americans or Palestinian-Americans. It’s simply wrong. There’s no place for racism in America. It’s all wrong. It’s un-American."

Biden took one question regarding US policy in the middle east and then left as reporters shouted more questions. Immediately following his strange condemnation, Harvard Professor Alan Dershowitz felt the need to respond to what the president had just said:

"Why can’t President Biden simply denounce antisemitism without pandering to Muslims and Arabs," Dershowitz posted on X, before later saying the crisis at hand was about antisemitism, discrimination and violence against Jews, not other groups. "Why won’t he just condemn Jew hatred?"

Meanwhile after the former President had once again, been stuck in court all day, still full of energy, he decided to walk from the courthouse to a NYC Fire Station delivering pizzas to the fire fighters.

Before delivering the Pizza, Trump made comments on the campus riots that were much different than those of Joe Biden:

"This is a movement from the left. These are radical left lunatics, and they've got to be stopped now because it's going to go on and on. And it's going to get worse, and worse," Trump said Thursday morning outside of a  Manhattan courtroom where he is standing trial .

Why is Trump exempt from the rules?   Why is it wrong to prosecute Trump for his wrongdoings to determine if they are indeed criminal and to then make the appropriate sentencing?   This is a real trial, with a real judge, jury, prosecuting and defense attorneys.   This is our system operating as it should.

Trump should abide by the rules rather than open his mouth and publicly demean and intimidate individuals.   But he cannot stop himself.   This moron even continues to bad mouth the judge presiding over his case.   What kind of nutcase does that?    And you want this clown to be PotUS??

(2) the judge served as a lawyer in the matter in controversy;

(3) the judge has been a material witness concerning it; or

Four things specifically.

1) the point on recusal in post 3.1.17. (He donated to Biden and his daughter makes millions working for democrats.)

2) his gag order is overly broad, and it has been placed on the defendant. It is supposed to protect the defendant.

3) he allowed a lot of damaging but irrelevant material to be entered into evidence such as the Access Hollywood tapes.

4) demanding that Trump be there every day during a political campaign.

You know very well, as does judge Merchan, that the prosecution doesn't really need the tapes if it can read excerpts, which constantly reminds the jury of the infamous tapes that were released during the 2016 campaign to destroy Trump. The prosecution has taken full advantage of that to keep casting the former President in the worst possible light. I don't know of many judges that even allow the prosecution to mention past controversies or even offenses in criminal cases. Even when somebody is on trial for assault and has committed it 20 times in the past, judges keep past offenses out of the case, but here judge Merchan allows everything, and he is also allowing the prosecution to proceed without specifying what the so-called crime that they allege Trump was trying to hide. The defense is left not knowing how to prepare a case when they don't know where the hidden crime is.


This is a criminal trial.   It is the normal case that the defendant be onsite during a criminal trial in New York.

Why not give us a link, like I did with the NY law on recusal?

First, Vic, you seem to impose your own meaning to the phrase "party to the proceedings".   The judge's daughter is not a party to the proceedings.   Second, if the judge must mandatorily recuse himself then this would have been dealt with legally.   The fact is that Trump's attorneys argued reasons that would fall under voluntary recusal and the judge, appropriately, denied to recuse himself simply because of his daughter's employment.

You are grasping at straws.

I already told you that the tapes were not played.   Excerpts were read.   Further, this is what judges do.   You playing armchair judge is not persuasive.

Trump is his own worst enemy.   His behavior is outrageous.   His actions are predatory and exploitive.   His view of women seems entirely appropriate for a trial in which he is accused of falsifying the payment of hush money to hide his infidelity from the public.

The charges the DA has brought forth are not federal election violations. They are 34 state charges of fraudulent business bookkeeping to cover-up the federal election violations Cohen and Pecker committed. Well within his jurisdiction and authority.

From August 2015 to December 2017, the Defendant orchestrated a scheme with others to influence the 2016 presidential election by identifying and purchasing negative information about him to suppress its publication and benefit the Defendant’s electoral prospects.  In order to execute the unlawful scheme, the participants violated election laws and made and caused false entries in the business records of various entities in New York.  The participants also took steps that mischaracterized, for tax purposes, the true nature of the payments made in furtherance of the scheme.

3. One component of this scheme was that, at the Defendant’s request, a lawyer who then worked for the Trump Organization as Special Counsel to Defendant (“Lawyer A”), covertly paid $130,000 to an adult film actress shortly before the election to prevent her from publicizing a sexual encounter with the Defendant.  Lawyer A made the $130,000 payment through a shell corporation he set up and funded at a bank in Manhattan.  This payment was illegal, and Lawyer A has since pleaded guilty to making an illegal campaign contribution and 1 served time in prison.  Further, false entries were made in New York business records to effectuate this payment, separate and apart from the New York business records used to conceal the payment.

4. After the election, the Defendant reimbursed Lawyer A for the illegal payment through a series of monthly checks, first from the Donald J. Trump Revocable Trust (the “Defendant’s Trust”)—a Trust created under the laws of New York which held the Trump Organization entity assets after the Defendant was elected President—and then from the Defendant’s bank account.  Each check was processed by the Trump Organization, and each check was disguised as a payment for legal services rendered in a given month of 2017 pursuant to a retainer agreement.  The payment records, kept and maintained by the Trump Organization, were false New York business records.  In truth, there was no retainer agreement, and Lawyer A was not being paid for legal services rendered in 2017.  The Defendant caused his entities’ business records to be falsified to disguise his and others’ criminal conduct.

No John, any lawyer who is worth his retainer will argue that non-disclosure agreements are common practice and are made for a variety of reasons. Nobody can get into a person's head to determine why. They are not illegal. The claim by the prosecutor is that a felony was committed to cover up a greater crime. Thus far, we have not been told what that crime is. In the meantime, the Judge has allowed all kinds of things entered into the case as "evidence," which are never allowed. He has also imposed a mostly unconstitutional gag order on the defendant. He is also in violation of a state law which requires him to recuse himself based not only on his own conflict of interest but that of his daughter as well.


Everyone is not as dumb as some Trump supporters.

You are trying to inform a career attorney (G2) about the law.

As I noted in my earlier reply to you, gag orders are to protect the integrity of the trial.   That often does mean protecting the defendant, but in some cases (like this one) the defendant is the problem.

When a defendant is using his celebrity-based megaphone to intimidate witnesses, jury, court operatives, etc. it is entirely appropriate for a judge to issue a gag order (at the least) to stop the defendant from harming the integrity of the trial.

Witnesses don't get to taunt Defendents.

Private citizen Cohen will likely be under some restrictions once he has testified (and thus has become privy to the inside of the courtroom).   I see nothing that prevents him from presenting his views on Trump (as he has done for many months now) prior to setting foot in the courtroom.    Where do you see his right to free speech limited at this point?

I don't know if the entire program has gone to SCOTUS yet. Federal judges have repeatedly ruled that DACA is unconstitutional but it keeps getting kicked down the road. 

The Supreme Court could decide within the next year whether to hear a case about the legality of the Deferred Action for Childhood Arrivals (DACA) policy.

In September 2023, Judge Andrew Hanen, a federal judge in the U.S. Southern District of Texas, who   issued a ruling   declaring that the DACA program is illegal. While Judge Hanen’s most recent ruling does not impact DACA recipients’ current protections or their ability to continue to renew them, the decision is another cruel and disheartening indication that the courts plan to terminate this vital lifeline for hundreds of thousands of young immigrants and their families.

Judge Hanen’s ruling is not the final step. An appeal of his ruling has been filed, and is being heard by the Fifth Circuit Court of Appeals, which also previously ruled against DACA. Assuming the Fifth Circuit rules the same way again, the case will then likely be appealed up to the Supreme Court. The timing of the Fifth Circuit’s decision is unpredictable, however, and the timeline for the Supreme Court to respond to a request to review the case could range from anywhere late 2024 to early 2025; if such a request is granted, the case may not be heard until spring 2025.

Because of Syria that has never ended its war against Israel, and Iran and its proxies such as Hezbollah, Hamas and the Houthies, along with many of the Palestinians, Israel still is not entirely safe for Jews.  The biggest antisemitic organization in the world and most of its members, the United Nations, and its UNRWA as well will never end its hatred, its multiple resolutions against Israel, and now university students around the world, touched off by the ones in America, cheer on the antisemitic call for the destruction of the State of Israel, the murder of the Jews, with their call "From the river to the sea" and glorify terrorism.  No, I fear that Jews are not even safe in Israel, they have never been safe and they never will be safe anywhere.

As far as the way Joe Biden has attempted to force Netanyahu to do what the US wants, it is not the first time Biden has done it.

Israeli officials have in recent days begun expressing fears that the International Criminal Court could issue arrest warrants against senior Israeli political and military figures, as the war between the Jewish state and Hamas in Gaza approaches its eighth month.

The ICC has not confirmed the Israeli claims, saying that while it has an “ongoing, independent investigation in relation to the situation in the state of Palestine”, which dates from 2021, it would not “give a running commentary” or respond to “speculation in media reports”.

Given a lack of confirmation — and the relatively slow pace at which the ICC has moved in other cases — there has been speculation in the Israeli media that the hand-wringing stems from political calculations by the country’s leaders who are under mounting pressure at home and abroad, rather than legal peril. But the claims have drawn renewed attention to the potential for legal actions over the Gaza war, which has already triggered a separate, high-profile case at the International Court of Justice.

Why is the ICC scrutinizing the war in Gaza? The ICC was set up in 2002 and has the power to prosecute individuals for crimes against humanity, genocide and war crimes. Its jurisdiction covers crimes committed on the territories of, and by the citizens of, the 124 states that have signed up to its statute. Palestine acceded to the statute in 2015, but Israel has not, and as such does not recognise the court’s jurisdiction.

However, after years of legal wrangling, the ICC determined that it did have jurisdiction over events in the Palestinian territories, and in 2021 opened an investigation into the “Situation in the State of Palestine”. The investigation’s initial remit included probing both alleged crimes committed during and since a previous war between Israel and Hamas in 2014, and Israel’s promotion of Jewish settlements in the occupied West Bank, which Palestinians seek as the heart of a future state. However, the court’s prosecutor, Karim Khan, confirmed in November that the investigation would also encompass the current war, which was triggered by Hamas’s surprise attack on Israel on October 7. ICC prosecutors are not only investigating allegations of war crimes by Israel, but also by Hamas and other militant groups active in those territories.



What could be the grounds for ICC arrest warrants?

Sheila Paylan, an expert on international law and human rights, said that if the ICC issued warrants against Israeli officials for events since October 7, they were likely to relate to the restrictions Israel imposed on humanitarian aid entering Gaza, and the indiscriminate killing of civilians. In the early days of the war, Israeli officials pledged to impose a “siege” on Gaza. But more recently, they have insisted they are not imposing any limits on the amount of aid entering the enclave. They also deny indiscriminately killing civilians.

However, humanitarian organizations say the amount of aid entering Gaza is a fraction of what is needed, and Palestinian officials say the majority of the more than 34,000 people killed by Israel in Gaza have been women and children. Palestinian lawyers who have given evidence to the court said any arrest warrants were most likely to be issued in order to facilitate the court’s investigations. For instance, having collected evidence from Palestinians on various alleged war crimes, the prosecutors would formally ask for Israeli officials to provide their own evidence on the issue.

Were Israel to deny that request, the court is empowered to seek their detention in order to satisfy its remit to fully investigate the alleged crimes. Paylan said she expected that any warrants issued by the court would also target Hamas involved in the October 7 attack, during which militants killed 1,200 people and took 250 hostages, according to Israeli officials.


What would the implications of ICC arrest warrants be for Israeli officials? Israeli officials subject to ICC arrest warrants would, in effect, be limited from travelling to any of the 124 countries that have signed the court’s statute, as these states would be obliged to arrest them and hand them over to the court.

Those countries include the UK, most European and Latin American countries, as well as numerous states in Africa and Asia. However, as the ICC has no enforcement mechanism of its own, it is reliant on member states to take action — and this does not always happen. In 2015, South Africa refused to arrest Sudanese leader Omar al-Bashir when he visited the country, even though he was subject to an ICC warrant. Legal experts said that beyond the direct impact of any arrest warrants, the very fact that the ICC had issued them could also have knock-on effects, such as making other countries less willing to supply Israel with weapons, or more prepared to impose sanctions of their own. “It could be a reason why other countries might want to impose sanctions, but it’s not a necessary consequence,” said Paylan.


What other legal challenges is Israel facing? The International Court of Justice — the UN’s top court, which deals with cases against countries, rather than against individuals — is already hearing a separate case brought by South Africa accusing Israel of committing genocide against Palestinians in Gaza.

Israel has vehemently denied the accusation, and the court is unlikely to reach a final decision on the merits of the case for years. However, it has imposed a series of interim orders on Israel, including ordering it in March to ensure that more food and humanitarian assistance reach Palestinians in Gaza, warning that famine was “setting in” in the enclave. Outside the courtroom, Israel is also facing challenges. Under a memorandum issued by US President Joe Biden earlier this year, secretary of state Antony Blinken must inform Congress by May 8 whether Israel’s claims that it is not using US weapons in contravention of international law are credible. If he finds that they are not, the administration could theoretically suspend future weapons transfers. Are the legal challenges likely to make Israel change tack?

Israeli leaders are adamant that the ICC will not affect how they are waging the war in Gaza. Even as he expressed fears on Sunday that arrest warrants were possible, foreign minister Israel Katz said Israel would not “bow our heads or be deterred”, vowing that the country would “continue to fight” until it had destroyed Hamas and secured the release of the roughly 130 hostages that Hamas is still thought to be holding in Gaza.

Chimène Keitner, professor of international law at the University of California Davis School of Law, said that while ICC arrest warrants could serve as “an impetus for domestic courts to start being more active”, she did not expect this to happen in Israel so long as Israeli hostages were still being held in Gaza, and while the current government was in power.
