The man accused of breaking into House Speaker Nancy Pelosi's house and attacking her husband with a hammer could be deported from the U.S. after he is released from custody, the Department of Homeland Security said Thursday.

U.S. Immigration and Customs Enforcement, or ICE, lodged an "immigration detainer" on 42-year-old Canadian national David DePape, DHS told CNBC in a statement.

The detainer requests that the San Francisco County Jail notify ICE before DePape is done serving time so that the immigration officers can take custody of him. ICE places immigration detainers on arrested individuals who it believes it can deport under the Immigration and Nationality Act.

Records show DePape entered the U.S. through the San Ysidro point of entry on the southern border in 2008 as a temporary visitor, classified as a B-2, officials said.

Canadian visitors who enter the U.S. for business or pleasure are generally only admitted for six months, officials said.

DePape, in his first court appearance Tuesday, pleaded not guilty to numerous charges including attempted murder. He is currently being held without bail, with his next hearing set for Friday, his public defender said.

The Justice Department has also charged DePape with two federal crimes: attempted kidnapping of a federal official and assaulting an immediate family member of a United States official with the intent to retaliate against the official, according to his criminal complaint.

Federal charging documents allege that DePape broke into the Pelosis' San Francisco residence early last Friday, confronting 82-year-old Paul Pelosi in his bedroom and stating "he was looking for Nancy."

The Democratic House speaker was in Washington, D.C., at the time. Paul Pelosi managed to call 9-1-1, and when officers arrived, DePape struck him in the head with the hammer, authorities said.

DePape himself later told police he saw the House speaker as the "'leader of the pack' of lies told by the Democratic Party," a federal affidavit said. He said he wanted to hold her hostage and talk to her, and if she lied he would break her kneecaps, the document said.

DePape arrived at the San Francisco home toting zip ties, tape, rope and at least one hammer, according to the affidavit.

In a Tuesday night court filing, San Francisco District Attorney Brooke Jenkins said DePape told police he was on a "suicide mission" and had plans to target other California and federal politicians.

Paul Pelosi is recovering in the hospital after undergoing surgery to repair a skull fracture.

(ii) knowing or in reckless disregard of the fact that an  alien  has come to, entered, or remains in the  United States  in violation of law, transports, or moves or attempts to transport or move such  alien  within the  United States  by means of transportation or otherwise, in furtherance of such violation of law;
(iii) knowing or in reckless disregard of the fact that an  alien  has come to, entered, or remains in the  United States  in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such  alien  in any place, including any building or any means of transportation;
(iv) encourages or induces an  alien  to come to, enter, or reside in the  United States , knowing or in reckless disregard of the fact that such coming to, entry, or  residence  is or will be in violation of law; or
(v) (I)engages in any conspiracy to commit any of the preceding acts, or
(II)aids or abets the commission of any of the preceding acts,
shall be punished as provided in subparagraph (B).
And, there are many more references supportive of the above.
I'd give them to you - but - don't think you'd read them - maybe not understand them - or, as usual, you'd ignore them.

How many Illegal immigrants have been sent to NYC, Washington DC, Chicago?  Why are they in the country?  Why weren't they required to wait for legal entry into the country?  And why isn't the Federal government keeping track of their whereabouts?

The Federal government didn't seem to be aware that DePape was in the country illegally.  The Federal government didn't seem to care until DePape committed a crime.  And the Biden administration appears to only want to enforce immigration laws now because DePape committed a crime.

I wonder if SF officials will honor the retainer just because it is regarding Pelosi's attacker?

I bet Kathryn Seinle and her family sure wish SF had done so before an illegal alien killed her.

This ungrateful asshole attacked one of theirs! Can't be having that!

Now if he would have attacked a high ranking Republican that would be different. Poor misguided man is obviously insane; and would be back out on the street by dinner. A simply assault charge would be levied; and there would be no talk of deportation.

Why would you ask that question? They have an answer i suspect as I am aware of a few that have. 

There is no moral high ground for democrats and republicans if we are going down the road of blaming political rhetoric for violence.

We might accomplish more without attempting to enjoy some small political victory. Not to mention we would need to pretend the past doesn't exist before a week ago. 

I think it's fair to say that both democrats and republicans believe the other is responsible for an uptick in violence. So why don't we talk about how we actually put a stop to violence? It's clear to rational people it's a bipartisan issue.

If one believes the Donald Trump Experience is a threat to both our democracy and the mental health of its citizens, then beating Trumpism and its related spin offs is a good in itself.

Jan 6 was political violence on a scale that we have not seen before. And that was a Trump/GOP/Right-wing project.

Ok, maybe the Civil War and the American Revolution were more violent (but we didn't see those).

There sure is a lot of senseless violence going on in America right now. People in NYC are horrified by the sharp uptick in random acts of violence on the subway system. These aren't even robberies. They are just assaults and stabbings with no real explanation.

Possibly, yes.

Assuming reported facts to be true:

OK, so our suspect assaulted the victim. If that was all that happened, we’d have a misdemeanor. But everything else about this makes it a basket of felonies.

The state of California has charged him with Attempted Murder, Residential Burglary, Assault with a Deadly Weapon, Elder Abuse, False Imprisonment of an Elder, and Threats to a Public Official.

You might wonder if the murder is 1st or 2nd degree. On it’s own, I think it would be 2nd degree. But . . .

Regardless of intent, a killing perpetrated while also engaging in - among other things - kidnapping or burglary is 1st degree murder.

‘Attempted” first degree murder is sentenced the same as successful first degree murder - life without parole.

Even without 1st degree murder, all of the above are categorized as “serious” or “violent” felonies and that tacks on more time than you’d get for some “harmless” felony. Plus, it’s multiple felonies and even that adds time. He wouldn’t get “Life,” but he’d get so much time that it wouldn’t make any difference. In California, he will be required to serve 85% of his time before parole becomes an option.

Additonally, perpetrating - or attempting to perpetrate - the above against a member of Congress makes them all federal crimes, and he can be charged and sentenced in federal court in addition to whatever the state does. The fact that Nancy was not at home makes no difference. He apparently didn’t know that. He expected her to be there, and that’s enough.

To this point, I think the feds have only charged him with assault and attempted kidnapping, which carries a maximum of 20 years (the feds do love long sentences). If they also charge him with assaulting an immediate family member of a US official - either in retaliation or attempt to influence that official - that could be 30 years.

It’s just hard to see him getting out of prison, ever.

Possibly is a long way from for sure.

From what I have read about the perpetrator, if he has a decent attorney, he might be able to plead insanity. Sure seems crazy to me, and some of what he has posted online bears that out.

If he is convicted and sentenced to anything OTHER than life without parole, he will be let out at some point (if he doesn't die first) and free to roam California since they do not honor ICE detainers.

That seems unlikely. I won’t disagree that he “seems crazy” but the Insanity defense is tough to pull off. There are basically two ways that works.

First, by some kind of mental defect or damage, he was unaware of the nature of what he was doing. Or, Second, he was somehow unable to distinguish between right and wrong when he committed the act.

I think the evidence is pretty strong that this guy knew exactly what he was doing.

What I can't understand is why a Canadian would be so concerned about an American politician to involve himself to that extent.  If I were him I'd plead insanity.  As well, I don't like the idea of deporting that maniac back to Canada - since he entered the USA from Mexico, send him back there.
