A federal judge on Thursday denied President Donald Trump’s latest attempt to quash   a probe by New York prosecutors   seeking his tax returns and other financial documents.

The ruling by U.S. District Judge Victor Marrero amounted to a second loss in Trump’s high-stakes court battle with Manhattan District Attorney Cy Vance.

Marrero had earlier rejected Trump’s initial attempt to block a subpoena from Vance seeking eight years of the president’s tax returns.

The Supreme Court ruled last month that the president is not immune from a grand jury subpoena while in office but said Trump could use an alternative argument to fight it.


In his 103-page ruling, Marrero rejected Trump’s new argument that Vance’s subpoena is “wildly broad” and was issued in “bad faith.”


“At its core, it amounts to absolute immunity through a back door, an entry point through which not only a President but also potentially other persons and entities, public and private, could effectively gain cover from judicial process,” Marrero wrote.

The decision moves Vance one step closer to obtaining the president's financial records. But within just a few hours of the ruling, Trump's lawyers filed an emergency motion appealing the decision and asking for a freeze on the case.

"The President respectfully disagrees with that decision and believes there is a likelihood of reversal on appeal," Trump's lawyers wrote. "But what matters most at this point is that, absent a stay, the subpoena will be enforced before the President has been afforded any appellate review of his overbreadth and bad-faith claims."

Vance’s office subpoenaed Trump’s accounting firm, Mazars USA, in 2019 as part of an investigation into the Trump Organization about payments made to two women who have alleged affairs with the president, which he has denied. In a   court filing earlier this month , Vance’s office suggested the investigation goes beyond the payments to include alleged insurance and bank fraud.

A spokesman for Vance’s office declined comment.

This quest for the returns is simply a fishing expedition that will yield no fish. It's too late now for anything found to much affect the election.

Trump of course will resist turning anything over until after the election...one of the privileges of being a sitting president.

Once he is reelected, the issue will quickly fade away. If the IRS is happy with his tax information, that's the end of the story.

Have you ever purchased a home?  Have you ever rented an apartment?  Have you ever opened a bank account... interviewed for a job... or applied for a credit card?  If you can say yes to any of these things, then you had to provide the same information that Trump has been ordered to provide.  I dare you to tell the people who would be considering your application for any of the above scenarios that you have no intention of providing your financial information.  You would become so familiar with rejection, that a Xanax dependency might be part of your homeless/bankless/jobless future.    

I don't expect The President of the United States to be held to the same standard that the average citizen is subjected to.  After-all, we are plebeians worthy of being judged.  Instead, I expect the President of the United States to be held to a higher bar by a factor of 10.

Michael Cohen testified under oath that he falsified bank documents. NYT published extensive evidence that he illegally transferred money from his father's estate and misrepresented his holdings on his taxes. He has a known history of bank and tax malfeasance going back forty years. His charity has already been shut down for corrupt practices, as was his "university".   Hardly a fishing expedition. We know the payments were made. We know they were illegal. YOU (there is no "we") assume they were illegal.  Since losing the election in 2016 and Trump NOT releasing his taxes as his predecessors have (which there is no legal requirement) it gave birth to the conspiracy theories the left has run with for 4 years now.

Now one's head has to be pretty far up their 4th point of contact to think that the Obama / Clinton campaign didn't use the IRS to look into Trumps finances.  If there were something probative, it would have been exposed.

For all NT members, especially those who have memory problems since I answered that question previously, I worry about my son and his family, including my only grandchildren, who live in Wisconsin.  He has a very important and highly respected job there, but I wish he would move with his family to Canada, where he comes from, notwithstanding his wife and my grandchildren are all American-born citizens.  As well, I have good friends on NT who are Americans. If Vance and company find nothing just be done with it and quit wasting the time and money of the American taxpayer. If they do find something, so something about it post haste and get on with it.
