Florida bill would require bloggers who write about governor to register with the state | WFLA

TAMPA, Fla. (WFLA) — Florida Sen. Jason Brodeur (R-Lake Mary) wants bloggers who write about Gov. Ron DeSantis, Attorney General Ashley Moody, and other members of the Florida executive cabinet or legislature to register with the state or face fines.

Brodeur's proposal, Senate Bill 1316: Information Dissemination, would require any blogger writing about government officials to register with the Florida Office of Legislative Services or the Commission on Ethics.

In the bill, Brodeur wrote that those who write "an article, a story, or a series of stories," about "the Governor, the Lieutenant Governor, a Cabinet officer, or any member of the Legislature," and receives or will receive payment for doing so, must register with state offices within five days after the publication of an article that mentions an elected state official.

If another blog post is added to a blog, the blogger would then be required to submit monthly reports on the 10th of each month with the appropriate state office. They would not have to submit a report on months when no content is published.

For blog posts that "concern an elected member of the legislature" or "an officer of the executive branch," monthly reports must disclose the amount of compensation received for the coverage, rounded to the nearest $10 value.

If compensation is paid for a series of posts or for a specific amount of time, the blogger would be required to disclose the total amount to be received, upon publication of the first post in said series or timeframe.

Additional compensation must be disclosed later on.

Failure to file these disclosures or register with state officials, if the bill passes, would lead to daily fines for the bloggers, with a maximum amount per report, not per writer, of $2,500. The per-day fine is $25 per report for each day it's late.

The bill also requires that bloggers file notices of failure to file a timely report the same way that lobbyists file their disclosures and reports on assessed fines. Fines must be paid within 30 days of payment notice, unless an appeal is filed with the appropriate office. Fine payments must be deposited into the Legislative Lobbyist Registration Trust Fund if it concerns an elected member of the legislature.

For writing about members of the executive branch, fines would be made payable to the Executive Branch Lobby Registration Trust Fund or, if it concerns both groups, the fine may be paid to both related trust funds in equal amounts.

Explicitly, the blogger rule would not apply to newspapers or similar publications, under Brodeur's proposed legislation.

In addition to the blogger regulations, the bill also removes provisions of state statutes to require judicial notices of sales to be published on publicly accessible websites, and specifies that a government agency can publish legally required advertisements and public notices on county sites if the cost is not paid by or recovered from an individual.

Should the bill pass, it would take effect immediately upon approval.

Although during my lifetime I've spent a fair amount of time in Florida, even owned with my brother a golf condo there that we inherited from our parents, I haven't set foot in that state for at least a quarter of a century, if not longer, and from the things that have been reported about the present government I sure as hell wouldn't want to go there again.

Interestingly authoritarian, but I don't think monetized blogging is a really big business in FL at the moment. Then again what's this clown's definition of blogger? Is anyone that writes an article here a blogger? Someone with a YouTube channel? A website that works off of Patreon donations? If the Republican Liberty Caucus of Florida puts out their newsletter are they subject to this law?

First I don't think it will work as intendent and second has the potential to be blocked by the first judge it comes before. Poor conservative populist snowflakes...

You just said it.... "one person".  What about a single person having a crazy idea is so alarming?  Individual people have batshit ideas all the time.

Serious question.... why is this foolishness somehow more problematic than any of the other foolishness that we encounter every minute of every day?

MGT wants a "national divorce", AOC wants to spend 20 years worth of tax revenue, Gavin Newsome wants to pay people for being black while his state runs $40 billion in the red.  Hank Thompson wants to move troops off of Guam so it doesn't tip over (true story).

Elected officials say spectacularly stupid shite all the time.  They propose utterly unconstitutional nonsense all of the time.  Why would this crackpot matter any more than any of the others?

Wow, what a mouthful that bill is.  While I support the increase in education dealing with STEM, and I agree that it's a good thing that at least 25 percent of degrees will be in the highest full-time job placement and only 10% of degrees are for the lowest full-time job placement and lowest earnings (educating to allow students to both reach their potential as well as with a degree that will actually allow them to support themselves) it should be pointed out that this was in the prior bill and is not a new addition to this latest HB999 bill.

1. The top 25 percent of degrees reported by the
163 university in terms of highest full-time job placement and
164 highest average annualized earnings in the year after earning
165 the degree.
166 2. The bottom 10 percent of degrees reported by the
167 university in terms of lowest full-time job placement and lowest
168 average annualized earnings in the year after earning the
169 degree.

I do have a concern about the substance of the bill.  While there have been stories about how biased some college teaching is with regards to CRT,  it seems to me that college should be where students are introduced to all ideas and allowed to discuss and grow.  I'm not a fan of all of CRT but I don't support any program that removes the ability for a student to freely learn and discuss new ideas.  The world requires that people be able to think for themselves and putting a muzzle on the education process at the college / university level really seems like a bad idea to me.  So long as it's taught honestly and fully and not from a biased perspective that is.

Citizens not being able to think for themselves reminds me of the current Republican and Democrat parties (as well as a few members on this board).

Florida Republicans file a 6-week abortion ban bill, which DeSantis has said he'd sign

The White House quickly criticized the legislation.

March 7, 2023, 5:46 PM

Florida Republicans filed legislation to impose a six-week abortion ban on Tuesday , during the first moments of the state Legislature's 2023 session -- a bill that Gov. Ron DeSantis has said he would sign should it be sent to his desk.

"We're for pro-life. I urge the legislature to work, produce good stuff, and we will sign," DeSantis said during a February briefing when asked if he would approve a so-called heartbeat bill that would ban abortions after six weeks.

The state currently prohibits almost all abortions after 15 weeks, restrictions that were put in place in July as the state appealed after a judge's ruling that the law violated the state's constitution.

Geez Louise! How many ways can you say “unconstitutional?” Or as the kids would say today, “tell me you hate the Constitution, Freedom, and Fundamental Rights without telling me . . . “

You get the idea.

I don’t think I need to quote the US Constitution. Instead, this is from the Florida State Constitution (my bolding):

ARTICLE I, SECTION 4. Freedom of speech and press.Every person may speak, write and publish sentiments on all subjects but shall be responsible for the abuse of that right. No law shall be passed to restrain or abridge the liberty of speech or of the press. In all criminal prosecutions and civil actions for defamation the truth may be given in evidence. If the matter charged as defamatory is true and was published with good motives, the party shall be acquitted or exonerated.

It’s like I get it when maybe states disagree with something in federal law. Maybe there’s a state that doesn’t protect speech or writing in its constitution (though I doubt it). So maybe that state doesn’t think the amendments should apply to the states. That’s a legitimate point of view.

But here? Here, I would say the Florida constitution has language protecting speech that is stronger than the federal constitution.

DeSantis needs all of the protection/adoration he can get.  He's still on untethered ground seeing as how the 'golf cart army' still possesses all of those Chinese made Trump flags.

DeSantis should use his head and contact Ivanka about some of her Chinese patents.  Perhaps they can work out a deal so DeSantis can get his own DeSantis Chinese flags for the Florida 'golf cart army'.

As far as DeSantis wanting bloggers to register with the state if his name is used, there again is a golden opportunity.  A $5 dollar a month fee for the rights for his name will add handsomely to his personal coffers.  Surprised he can't see this.

This is another one that DeSantis is pushing.

DeSantis demanded new defamation law

The Florida Legislature is separately considering proposals that would make it easier for people to sue media organizations for defamation; these proposals have also been   criticized   for harming freedom of speech. Brodeur filed   one of the defamation proposals   on Monday.

The defamation proposals were spurred by DeSantis, who last month held a roundtable discussion on media defamation and   called on   the legislature "to protect Floridians from the life-altering ramifications that defamation from the media can cause for a person who does not have the means or the platform to defend himself."

"We've seen over the last generation legacy media outlets increasingly divorce themselves from the truth and instead try to elevate preferred narratives and partisan activism over reporting the facts," DeSantis said. "When the media attacks me, I have a platform to fight back. When they attack everyday citizens, these individuals don't have the adequate recourses to fight back. In Florida, we want to stand up for the little guy against these massive media conglomerates."

A.  Because there was already a first amendment.

The entire reason for the first amendment is so that the people can criticize the government.  The inevitable court challenge will certainly shoot this down.  If it doesn't I would expect Biden to do the same thing nationwide.

TAMPA, Fla. (WFLA) — Florida Sen. Jason Brodeur (R-Lake Mary) wants bloggers who write about Gov. Ron DeSantis , Attorney General Ashley Moody, and other members of the Florida executive cabinet or legislature to register with the state or face fines.

Cancel culture gone wild! How did Republicans completely about face and go from "Freedoms" to "Dictator"? I have never seen Republicans go so wild on cancelling Americans choice over so many issues. They have completely abandoned the concept of freedom and choices. While we are still able to buy alcohol, how long until these rabid right wing nuts going to go before they bring back the "Prohibition Era". Take away the right to have an alcoholic beverage because religious folks don't want it around? That is exactly where they are going on many of our American freedoms and rights.
