Texas AG threatens to prosecute doctors in emergency abortion

Texas Attorney General Ken Paxton on Thursday threatened to prosecute any doctors involved in providing an emergency abortion to a woman, hours after she won a court order allowing her to obtain one for medical necessity.
Paxton said in a letter that the order by District Court Judge Maya Guerra Gamble in Austin did not shield doctors from prosecution under all of Texas's abortion laws, and that the woman, Kate Cox, had not shown she qualified for the medical exception to the state's abortion ban.

The government of Texas literally heard from a woman, a citizen, who fears for her life and her future ability to "populate" the state with additional children and the state sided with her loss of this child through leaving the state (may be even for good)! It's a clear demonstration of Texas government 'controllers' not being interested in the life of the mother or her future off-spring over a pretense that every child (unfit or fit) matters!
All women who care about autonomy over their own bodies should flee Texas like the plague.
(Fleeing to Florida or any other Southern redneck state is obviously not an option.)

The business of Texas is business, especially the oil business. While there are beautiful spots in the giant state, its cities are hellscapes. Dallas is a sprawling megalopolis. Houston is a swampy speedway. No, they don't have a state income tax, but they make up for it in monstrous property taxes, sales taxes, fees and surcharges. Services are few and far between. Now though, Texas has become oppressive. Been there, done that. I would never live there for love or money ever again!
It was many years ago that I visited Texas, more than once, and there were some outstanding things about it that I remember, one being the steak I ate at the Traildust in Dallas, where fortunately I didn't wear a tie, and being in the audience to watch and hear Ann Richards speak, who I thought would have been a fabulous POTUS.
Better to be thought the fool than to take to the keyboard to prove it.

Those analyses that try to classify states as givers or takers is shallow. They are developed and used politically that profess to care about income inequality and then label a state because that state historically has had a disproportionate amount of poor people living there.

I remember a few years back when a few state legislators introduced bills calling for the death penalty for women who'd had miscarriages and couldn't prove they hadn't caused them. I never thought such bills would get much traction. Now, I'm not so sure.
Nor am I. It's hard for me to believe that a nation that proudly hails itself as the greatest in the world tolerates such backwardness.
Kind of eliminates their entire claim to be pro-life when their actions could result in the deaths of both the mother and baby if carried to term.

So the state legislature will become the final arbiter in these cases? So much for doctor/client privilege. So much for limited government interfering in our lives. So much abject intolerance. So little empathy.
Not really. The legislators should be writing the laws in a clear enough way where the courts are not needed. In this case it seems the supreme court decided there was an issue with the doctor not meeting the "doctors reasonable medical judgment” when saying it was the "doctors belief" an abortion was needed. That is still between the doctor and patient. It seems a bit nit picky in the wording to me but I am not a lawyer. It seems if the doctor said it was their reasonable medical judgement even after the judgement came down they could have proceeded with the abortion in Texas.

Cox was compelled to cross state lines to endure a procedure that she certainly didn’t anticipate nor hope for. It became her reality when her state legislature, state officials, and state courts failed her in their ‘nit pickiness’.
Who knows what she faces going forward as she tries to regain her life in the spotlight of such intolerance for a woman’s privacy?
Yes, nit picky as described above. It seems the Supreme court interpreted the law looking for a specific wording to allow an abortion for medical reasons that were not supplied.
Based on what the Supreme court said I am not sure she had to leave. The courts interpreted the law. That is their job, not to make the law.
In her specific case the legislature did not make a law that was in her best interest at this time. If enough people don't like the law and it is important enough for them they can vote the legislators out. I don't know anyone is happy with all the laws they have to obey, that is why we have elections, so some of the laws can be changed.
IMO the decision is equivocal, and I don't blame the doctors for not taking a chance to spend the rest of their lives in prison for performing an abortion procedure. She was wise to run elsewhere.
That was her and her doctors choice and it was totally up to them.
The time-line to correct the mistake of a legislated body by replacement of officials is lengthy at best. By that time, this specific issue would be mute. And not just for this one decision-maker.

An abnormal fetus that is only able to survive for, at best, a few days out of the womb, where an emergency abortion was not allowed, will henceforth be known as a "Paxton Baby".
If she is not allowed to abort, there is a chance she'll miscarry, with the resulting dangers of a late miscarriage. It's also possible she'll require a c-section to deliver if the pregnancy progresses. She's already had several c-sections. Multiple c-sections increase the chance of uterine rupture in subsequent pregnancies, and that can be fatal.
My 2 children had to be delivered by c-section by my first wife, and they always were and are very healthy. I was made to leave the room for the first one and I'm embarrassed to say I fell asleep during the second one - the surgeon woke me up to tell me it was a brother for his 4 yr old sister.
The whole thing is unconscionable.
My son was born by c-section. It's a difficult recovery, or it was for me.
My wife had her tubes tied after her 2.
The bottom line is that once a c-section always a c-section.

Not always. Many doctors offer to help patients vaginal birth after c-section. But most will require a hospital birth (not home or a birthing center), and patients are informed that it's risky.

If Ms. Cox or the product of the pregnancy dies charge the AG with man slaughter. ( the crime of killing a human being without malice aforethought, or otherwise in circumstances not amounting to murder.)
Another charge could be terroristic threat (A terroristic threat is a threat to commit a crime of violence or a threat to cause bodily injury to another person and terrorization as the result of the proscribed conduct .)

This is disgusting. Someone I hold near and dear to me had to have an abortion because of a trisomy 18 defect. It was the worst moment of her life. Why are they forcing a woman to give birth to a baby with no nervous system? They are the monsters here.

Not necessarily. There is the chance. She has already had 2 c-sections. If this pregnancy continues, she may need her third. Risk of complications such as uterine rupture increase with each c-section, so this could render her sterile, or render future pregnancies more risky.
I should have been more specific. I meant a normal delivery. In this woman's case, she does have a risk, but carrying to term presents a risk, too. That is why it should be left to her doctors and not politicians and courts to decide.
Exactly. The risks might be worth it for a viable pregnancy. She doesn't find the risks to be worth it for a pregnancy that may result in miscarriage or stillbirth, and at best will result in a child that can't survive, and that decision should be hers, not Paxton's.
