WASHINGTON (AP) — The Supreme Court is keeping pandemic-era limits on asylum in place for now, dashing hopes of migrants who have been fleeing violence and inequality in Latin America and elsewhere to reach the United States.

WASHINGTON (AP) — The Supreme Court is keeping pandemic-era limits on asylum in place for now, dashing hopes of migrants who have been fleeing violence and inequality in Latin America and elsewhere to reach the United States.

Tuesday's ruling preserves a major Trump-era policy that was scheduled to expire under a judge's order on Dec. 21. The case will be argued in February and a stay imposed last week by Chief Justice John Roberts will remain in place until the justices make a decision.

The limits, often known as Title 42 in reference to a 1944 public health law, were put in place under then-President Donald Trump at the beginning of the pandemic, but unwinding it has taken a torturous route through the courts. The U.S. Centers for Disease Control and Prevention attempted to end the policy in April 2022, but a federal judge in Louisiana sided with 19 Republican-led states in May to order it kept in place. Another federal judge in Washington said in November that Title 42 must end, sending the dispute to the Supreme Court. Officials have expelled asylum-seekers inside the United States 2.5 million times on grounds of preventing the spread of COVID-19.

Immigration advocates sued to end the policy, saying it goes against American and international obligations to people fleeing to the U.S. to escape persecution. They've also argued that the policy is outdated as coronavirus treatments improve.

The Supreme Court's 5-4 decision comes as thousands of migrants have gathered on the Mexican side of the border, filling shelters and worrying advocates who are scrambling to figure out how to care for them.

"We are deeply disappointed for all the desperate asylum seekers who will continue to suffer because of Title 42, but we will continue fighting to eventually end the policy," said Lee Gelernt, a lawyer with the American Civil Liberties Union, which had been arguing to end Title 42′s use.

Andrea Rudnik, co-founder of non-profit immigration aid organization Team Brownsville in South Texas, said the situation at the border is a humanitarian crisis. She said there are thousands of migrants camped on cardboard boxes and in makeshift tents near the entrance of the Gateway International Bridge in Matamoros, Mexico, opposite Brownsville, without food, water, clothing or bathrooms.

"It is very readily becoming a dangerous situation because there's no toilets," Rudnik said. "Get that many people together with no bathrooms and you know what you have got."

States that wanted Title 42 kept in place hailed the outcome. In a press release Tuesday, Iowa Gov. Kim Reynolds praised the court's decision while saying it's not a permanent solution to the country's immigration woes.

"I'm grateful that Title 42 remains in place to help deter illegal entry at the US southern border. But make no mistake — this is only a temporary fix to a crisis that President Biden and his administration have ignored for two years," she said.

The Supreme Court's decision said that the court will review the issue of whether the states have the right to intervene in the legal fight over Title 42. Both the federal government and immigration advocates have argued that the states waited too long to intervene and — even if they hadn't waited so long — that they don't have sufficient standing to intervene.

In the dissent, Justices Neil Gorsuch and Ketanji Brown Jackson wrote that even if the court were to find the states have the right to intervene and Title 42 was lawfully adopted "... the emergency on which those orders were premised has long since lapsed."

The justices said the "current border crisis is not a COVID crisis."

"And courts should not be in the business of perpetuating administrative edicts designed for one emergency only because elected officials have failed to address a different emergency. We are a court of law, not policymakers of last resort," the justices wrote.

Justices Elena Kagan and Sonia Sotomayor also voted to deny the stay but did not sign a dissent.

White House press secretary Karine Jean-Pierre said Tuesday that President Joe Biden's administration "will, of course, comply with the order and prepare for the Court's review."

"At the same time, we are advancing our preparations to manage the border in a secure, orderly, and humane way when Title 42 eventually lifts and will continue expanding legal pathways for immigration," Jean-Pierre added. "Title 42 is a public health measure, not an immigration enforcement measure, and it should not be extended indefinitely."

In November, a federal judge sided with advocates and set a Dec. 21 deadline to end the policy. Conservative-leaning states appealed to the Supreme Court, warning that an increase in migration would take a toll on public services and cause an "unprecedented calamity" that they said the federal government had no plan to deal with.

Roberts, who handles emergency matters that come from federal courts in the nation's capital, issued a stay to give the court time to more fully consider both sides' arguments.

The federal government asked the Supreme Court to reject the states' effort while also acknowledging that ending the restrictions abruptly would likely lead to "disruption and a temporary increase in unlawful border crossings."

The precise issue before the court is a complicated, largely procedural question of whether the states should be allowed to intervene in the lawsuit. A similar group of states won a lower court order in a different court district preventing the end of the restrictions after the Centers for Disease Control and Prevention announced in April that it was ending use of the policy.

Until the judge's November order in the advocates' lawsuit, the states had not sought to take part in that case. But they say that the administration has essentially abandoned its defense of the Title 42 policy and they should be able to step in. The administration has appealed the ruling, though it has not tried to keep Title 42 in place while the legal case plays out.

The Biden administration still has considerable leeway to enforce Title 42 as aggressively or as leniently as it chooses. For example, when a judge ordered last year that Trump's "Remain in Mexico" policy to make asylum-seekers wait in Mexico for hearings in U.S. immigration court be reinstated, it did so with such limited scope that it had little impact. That policy ended in August after the administration prevailed in the Supreme Court.

The Biden administration's use of Title 42 includes an opaque, bewildering patchwork of exemptions that are supposed to be for migrants deemed most vulnerable in Mexico, perhaps for gender identity or sexual orientation, or for being specifically threatened with violence. U.S. Customs and Border Protection works with partners it doesn't publicly identify and doesn't say how many slots are made available to each.

Mexico is another wild card. The use of Title 42 to quickly expel migrants depends largely on Mexico's willingness to accept them. Right now Mexico takes expelled migrants from Guatemala, Honduras, El Salvador and Venezuela, in addition to Mexico, but not other countries, such as Cuba. Most asylum seekers who cannot be sent to Mexico are not expelled.

Biden is scheduled meet with Mexican President Andres Manuel Lopez Obrador in Mexico City next month.

We have immigration laws. We have borders. Neither are being enforced. 

It's sad that there is no way to test migrants for COVID. Oh, wait... there's a test (and vaccines and treatments).

Talk to Brandon. He has been in charge for the last two years. Still no mandatory testing and forced vaccinations in place for illegal immigrants. He only deems that necessary for the military; federal workers; and federal contractors. He doesn't want to violate any illegal immigrants' rights. 

Butt, we all know, the immigration policy is what really needs to be cured.

Been there done that with Reagan and the Democrats. Democrats got the general amnesty they wanted. Border is still wide open. Immigration law enforcement is still a joke whenever a Democrat is in the White House.

So would Reagan agree to do it again for the estimated 11-12 million illegal immigrants living here now? Apparently not.

Robinson relies on Ed Meese, Reagan's Attorney General and close advisor, to explain to him that Reagan did, after all, sign a bill that increased border control personnel 50 percent and also workplace enforcement. That law made "hiring undocumented workers a crime, requiring employers to attest to their workers' legal status." Too bad, in order to comply those hiring could evade responsibility by accepting any form of documentation, fraudulent or not.

In the end, Robinson concludes Reagan would now opt for an "Enforcement First" policy. Reforms intended to normalize the status of illegal immigrants "would simply have to wait, yielding to a single imperative: restoring the rule of law." Before enacting new statues, Reagan would have insisted, the federal government must enforce those on the books. It must "regain control of borders."

Apparently in response to Meese's remedial tutorial, Robinson ventures to say that "The fate of the Immigration Reform and Control Act would have infuriated him" [Reagan] because "he never envisioned immigration as chaotic or ungoverned."

Reagan was a man who examined history and learned from it. Having been burned once by the 1986 Immigration and Control Act's failed efforts to control illegal immigration through actual and effective workplace verification procedures instead of loophole-ridden symbolic measures, it is easy to envision President Reagan giving an oval office address on legal immigrants and workplace enforcement slightly altering words he had famously applied to another problem , arms control, plagued by a decade failed policy efforts: "Welcome, but verify!"

Brandon and the Democrats have to prove they are willing to enforce our borders and immigration laws as is. Before there is any talk of immigration reform.

Sam Houston quite adroitly, asked the US to fight the Mexicans to keep the stolen land safe, so Texas might always be a free country of its own and a sometimes state for the "bennies".

There would be a US-Mexican border regardless of Texas, the line would just be north of Texas.  

The Spanish first stole this land then various Mexican attempts at governing attempted to keep up but had trouble controlling the local Comanche, so they invited Anglo settles to the region.  

When Santa Anna sought to suspended the constitution and placed all federal power in his hands, a Mexican civil war started. Three new governments declared independence: the Republic if Texas, the Republic of Yucatan and the Republic of Rio Grande.

The majority have been pulled off the border, and their jobs protecting it, to process the massive influx of illegals caused by Brandon and the Democrats rescinding Trump EO's, and stopping wall construction,  that were working keeping the border closed.

Again, talk to Brandon. He is letting border states and cities deal with the overwhelming influx of illegals that he is doing nothing about. Not sure which part to handle first. Your complete lack of awareness of when the current crisis on the border started; or lack of knowledge of geography. There are other border states that are suffering from a massive influx of illegals. Arizona, New Mexico, and California also border Mexico as well.

YUMA, Arizona ( Border Report ) — You have probably never heard of the Yuma Gap, but many migrants from all over the world are certainly finding out about it.

It’s located in a small corner along the southern border where Arizona, California and Mexico intersect.

The border barrier is here, but there are many areas where it’s open and not connected.

Across the agency’s 262-mile Tucson Sector, from Douglas and Nogales, to Arivaca, Ajo and onto the Tohono O’odham Reservation, illegal crossers keep coming, lines of them wearing camouflage clothing and carpet booties to throw off trackers.

They trek over our mountains and deserts and cram into the trunks of load vehicles. Border Patrol is overwhelmed. Their radios squawk nonstop.

In fiscal 2021, Tucson Sector agents recorded 120,509 arrests, almost as many as the previous four years combined, according to agency statistics. So far in fiscal 2022, arrests are up 73 percent over that.

A growing number are not the desperately poor of popular belief. They dress in nice clothes and have newer iPhones than the agents who encounter them.

Some say arrests looks worse than they are because of a Trump-era public health policy, still in effect, intended to deal with COVID. Known as Title 42, it allows border officials to quickly push crossers back into Mexico. About 35 percent of them are arrested again, boosting the numbers.

But annual arrest numbers have always included multiple arrests of the same individual, and Border Patrol says the arrest recidivism rate has remained steady at around 35 percent since the 1990s.

The argument also fails to acknowledge the large number of gotaways, those who are spotted but evade capture. This summer, after Biden forced him out as Border Patrol’s chief, Rodney Scott said in TV interviews that there were more than 400,000 known gotaways across the Southwest border last year.

A fourth of those—120,000—passed through the Tucson Sector, according to the agency. These are people walking into the country unchecked for possible criminal backgrounds and almost certainly unvaccinated. 

Of those arrested in the Sector last year, 1,743 had prior criminal convictions in the U.S. The worst of the worst show up on the Sector’s Facebook page as significant arrests (see sidebar).

On a single day, Oct. 25, agents working near Bisbee arrested three felons previously convicted in the U.S.—for sodomy in Georgia, for lewd and lascivious acts with a child in California, and for assault with a deadly weapon, also in California.

To be sure, these dangerous individuals make up a small percentage of those crossing. But we can also be sure there are many more criminals of every kind among the gotaways.

Please tell us all when the border was this bad before? When there was two years straight of record breaking illegal immigrant crossings with no end in sight? With 2023 promising to set a new record already.

I believe it's two-fold.  The lie told by the Biden Administration about how they received a completely broken and unrepairable system from the Trump Administration and the lie being told about how Republicans currently are refusing to work with Democrats to fix current immigration law.   It's an expansion of the old "blame the prior administration" piece where they are just adding partisan bullshit on top like a cherry.

For shits and giggles, lets say their lie (that the border was irreparable) is accurate.  They still have an obligation to fix it.  To date they haven't done anything.  They've even gone as far as telling border states that are doing something to stop and dismantle what they have done.

Now, back to reality.  The Biden Administration had everything already laid out for them to secure the border.  All they had to do was sit back and let it run.  But, because of their hissy fit, they stopped it all.  Now we have a disaster at the border and they refuse to do anything about it.  Even their beloved sanctuary cites are failing in their promises.  And they expect everybody to think they will do the right thing.

They will just head to South or Central America- pass through Mexico; and enter the US like everyone else that doesn't want to wait in line across our wide open southern border. The Supreme Court just gave the country a reprive for another few months when the Supreme Court will decide the case on the merits. Border states have argued that they have unfairly had to carry the burden of protecting their own borders from waves of illegal migrants. In the meantime the Biden administration fought to end Title 42. Clearly, Biden's handlers want the southern border as wide open as possible. The drug Cartels have made money on it via Fentanyl and sex trafficing. The leftist media is not covering this major story and the left feels they are replacing voters as well as a race of people. We have laws that actually punish people for entering the country illegally. When is the last time anyone ever heard of an illegal migrant being punished for violating American law?

Title 42 was a pandemic era policy. One could argue that it's purpose no longer exists, but by not having it in place would mean that the southern border would be even more out of control than it now is. The real solution will come when Republicans have full power and they can enact Asylum reform in which people are not allowed asylum simply because they say "I'm fearful."

The online profile that sold Donald Trump 's non-fungible token (NFT) collection has also been trading in sexually explicit art.

The TrumpDeployer account, which housed the former president's "digital trading cards" on the NFT trading platform OpenSea, is also being used to purchase other online collectables that are pornographic in nature.

As well as more traditional NFTs, such as those from the popular Bored Ape Club, the TrumpDeployer account has traded several NFTs with an account called Freiburg, which sells "erotical art" featuring naked women and penetrative sex.

According to data available on the OpenSea website, the TrumpDeployer account has traded 14 erotic NFTs since it was set up nearly three weeks ago.

It is unclear who is behind the TrumpDeployer account, and there is nothing stopping them trading other NFTs while selling those from the former president.

A Q&A section on the Collect Trump Cards website states that money raised from the sale of the online tokens, drawn by illustrator Clark Mitchell, will not be used for Trump's 2024 presidential campaign.

The Collect Trump Cards website adds that the company behind the cards, NFT INT LLC, is "not owned, managed or controlled by Donald J. Trump or The Trump Organization" and they were created using Trump's name, likeness and image under a paid license.

Trump was widely mocked for teasing a "major announcement" which later turned out to be NFTs of him dressed in a number of guises such as a cowboy and astronaut.
